Siendo este un aporte importante para la defensa y protección de los derechos de los niños, niñas y adolescentes en nuestro país, asimismo, posibilita el diseño de un procedimiento administrativo de índole migratorio que pueda ser accionado en aquellos casos en los cuales se logre detectar a menores de edad extranjeros que desean ingresar a nuestro país sin contar con el acompañamiento de sus progenitores o de alguna persona mayor de edad debidamente autorizada. Con la finalidad de alcanzar dicho objetivo se requirió analizar y comprender las cuestiones principales vinculadas al procedimiento administrativo migratorio y el Interés Superior del Niño, lo cual permitió identificar los derechos vulnerados de los menores de edad extranjeros que desean ingresar al Perú sin el acompañamiento de sus padres o persona autorizada ante la falta de un procedimiento administrativo migratorio que coadyuve a la solución de esas situaciones. El desarrollo de esta investigación contó no solo con una perspectiva jurídica sino también social orientada a la protección y salvaguarda de los derechos de los menores de edad extranjeros que desean ingresar a nuestro país sin el acompañamiento de sus padres o persona mayor de edad autorizada y encuentran un sin número de vicisitudes que ponen en riesgo su integridad ante la falta de una regulación de carácter administrativo migratorio aplicable.The purpose of this investigation is to determine how the lack of regulation of the immigration administrative procedure violates the Best Interest of the Child of foreign minors in Perú. This being an important contribution to the defense and protection of the rights of children and adolescents in our country, it also makes it possible to design an administrative procedure of a migration nature that can be activated in those cases in which it is possible to detect foreign minors who wish to enter our country without being accompanied by their parents or a duly authorized person of legal age.
