Repositorio de Tesis USAT.RTU008278http://hdl.handle.net/20.500.12423/8627En el presente trabajo de investigación se realizó un análisis a la conducta de la víctima y del sujeto activo, con el fin de identificar en qué circunstancias se presenta la figura de autopuesta en peligro de la víctima, la cual debe ser considerada como una causal para eximir la adjudicación de una reparación civil a favor del agraviado. Además de ello, se examinaron los delitos culposos dentro de la normativa peruana y con ello, su imputación objetiva; ya que de esa manera se puede brindar un panorama más claro acerca de esta figura. En consecuencia, para el desarrollo de los objetivos trazados, se empleó el método cualitativo, mediante el cual se recopiló información de libros, revistas e investigaciones. Por tanto, como resultado de la investigación se proporcionaron criterios para determinar la inexistencia de responsabilidad civil en el supuesto de autopuestopuesta en peligro de la víctima, con la finalidad de que el juzgador, pueda tomar en cuenta diferentes aspectos de las partes involucradas al momento de la investigación, y por ende, tome la decisión más acertada y justa.In the present research work, an analysis was carried out on the behavior of the victim and the active subject, in order to identify under what circumstances the figure of self- endangerment of the victim occurs, which must be considered as a cause for exempt the award of civil reparation. In addition to this, culpable crimes were examined within Peruvian regulations and with it, their objective imputation; since in this way a clearer picture of this figure can be provided. Consequently, to develop the objectives set, the qualitative method was used, through which information was collected from books, magazines and research.
