Repositorio de Tesis USAT.RTU008616http://hdl.handle.net/20.500.12423/8970El presente trabajo de investigación se centra en la defensa de la dignidad, entendida como una virtud inherente a la naturaleza humana, que deben ser reconocidos por cualquier ordenamiento jurídico. En este contexto, el derecho a la salud se erige como un derecho fundamental que enfrenta desafíos en el marco de la eliminación de barreras burocráticas en el Perú, en donde si bien la simplificación dministrativa busca fomentar el desarrollo económico, es esencial que este proceso no se tome a la salud como un commodity comercial. La Comisión de Eliminación de Barreras Burocráticas de Indecopi, creada para salvaguardar los derechos económicos de los ciudadanos, busca eliminar obstáculos injustificados que limitan su acceso al mercado. Sin embargo, la Resolución 0102-2024-SEL-INDECOPI suscita preocupaciones al permitir la venta de víveres y la prestación de servicios médicos en farmacias, generando una contradicción entre la protección del ser humano como fin supremo y la reducción de su valor a una mera transacción comercial. Por ello, es necesario revisar estas regulaciones para garantizar que la simplificación administrativa no se convierta en un impedimento para el acceso equitativo a la salud y el bienestar social, priorizando siempre la dignidad humana y los derechos fundamentales del ser humano.This research paper focuses on the defense of dignity, understood as a virtue inherent to human nature, which must be recognized by any legal system. In this context, the right to health is established as a fundamental right that faces challenges in the framework of the elimination of bureaucratic barriers in Peru, where although administrative simplification seeks to promote economic development, it is essential that this process does not take health as a commercial commodity. The Commission for the Elimination of Bureaucratic Barriers of Indecopi, created to safeguard the economic rights of citizens, seeks to eliminate unjustified obstacles that limit their access to the market. However, Resolution 0102-2024-SEL-INDECOPI raises concerns by allowing the sale of food and the provision of medical services in pharmacies, generating a contradiction between the protection of the human being as the supreme goal and the reduction of its value to a mere commercial transaction.
