Repositorio de Tesis USAT.RTU007367http://hdl.handle.net/20.500.12423/7698En la presente, la investigadora tuvo como objetivo general analizar los criterios para determinar el quantum indemnizatorio de daños extrapatrimoniales en la Responsabilidad Civil Extracontractual, Distrito Judicial de Chiclayo, 2022. En ese sentido, se desarrolló un tipo de investigación básica, de nivel descriptivo, de diseño no experimental, y corte transeccional. Asimismo, se utilizaron la encuesta y el análisis jurisprudencial como técnicas de investigación y el cuestionario con la guía de observación como instrumentos respectivamente, los cuales sirvieron para medir la variable de estudio. Se obtuvo como conclusión principal que debe establecerse criterios para determinar el quantum indemnizatorio en daños extrapatrimoniales mediante el empleo de métodos cuantitativos basados en modelos teóricos que permitan liberar a los justiciable de fallos arbitrarios dejando a la libre discrecionalidad subjetiva de los magistrados el monto de la indemnización.In the present, the researcher had as general objective to analyze if criteria should be established to determine the compensatory amount of extra-patrimonial damages in the Extra-contractual Civil Responsibility, Judicial District of Chiclayo, 2022. In this sense, a type of basic investigation was developed, of level descriptive, non experimental design, and transectional cut. Likewise, the survey and the jurisprudential analysis were used as research techniques and the questionnaire with the observation guide as instruments, respectively, which served to measure the study variable.
