Para ello ha sido imprescindible realizar una descripción de la definición e importancia de la Seguridad Social, así como de aquellos principios que fundamentan esta institución tales como: Solidaridad, Universalidad, Pro Asegurado y la relación intrínseca con el Principio – Derecho de Dignidad humana; para posteriormente poder comprender el valor conceptualizado de la Pensión de Invalidez en el DL. 19990 y sus modificatorias identificando los aspectos que viene soslayando a través de pronunciamientos administrativos por su ente rector la Oficina de Normalización Previsional ante solicitudes de esta prestación. Por último, establecemos los principales argumentos que sustentan la implementación de la figura del préstamo previsional como mecanismo jurídico cuya aplicación pragmática permitirá contribuir a garantizar el acceso y reconocimiento de la pensión de invalidez reflejando el fin tuitivo de la Seguridad Social en el SNP.The purpose of this research is to establish the criteria for the implementation of a legal mechanism to guarantee the protection of the right to social security of the affiliates for the recognition of the disability pension in the event of contingencies in the National Pension System. For this purpose, it has been essential to make a description of the definition and importance of Social Security, as well as of those principles that underlie this institution such as: Solidarity, Universality, Pro Insured and the intrinsic relationship with the Principle - Right of Human Dignity; in order to subsequently understand the conceptualized value of the Disability Pension in DL. 19990 and its amendments, identifying the aspects that have been avoided through administrative pronouncements by its governing body, the Office of Social Security Normalization, in the face of requests for this benefit.
