Vulneración de los derechos fundamentales de líderes indígenas de la Amazonía peruana en defensa de sus pueblos y el ambiente

Resumen
La vulneración de los derechos fundamentales de líderes indígenas es común en la Amazonía, debido a su rol en la conservación ambiental y cultural, exponiéndolos a amenazas de actores que buscan explotar recursos naturales. En Perú, esta situación se agrava por actividades ilícitas y la limitada intervención estatal, resultando en asesinatos y conflictos. La presente investigación tiene como objetivo general demostrar la deficiente asistencia por parte del Estado peruano sobre la vulneración de los derechos fundamentales de líderes indígenas en la Amazonía peruana en defensa de sus pueblos y del ambiente. Como objetivos específicos: identificar las normas establecidas para la protección del ambiente de la Amazonía peruana ante los delitos ambientales; determinar las principales actividades ilícitas que atentan contra los pueblos indígenas y el ambiente que vulneran los derechos fundamentales de los líderes indígenas de la Amazonía peruana; comparar la efectividad de las medidas internacionales interpuestas para la protección de los derechos fundamentales de los líderes indígenas con países latinoamericanos; y finalmente analizar las principales medidas establecidas por la legislación peruana para la protección de los derechos fundamentales de los líderes indígenas. Como metodología se utilizó un enfoque cualitativo mediante análisis documental de informes, artículos, jurisprudencias y noticias. Los resultados indican que las actividades ilícitas en la Amazonía peruana van en aumento, así como los asesinatos de líderes indígenas, mientras que las entidades responsables no cumplen efectivamente su rol debido a la escasa participación en reuniones y la insuficiencia del aporte presupuestal para el mejor desarrollo del Mecanismo intersectorial.
The violation of the fundamental rights of indigenous leaders is common in the Amazon, due to their role in environmental and cultural conservation, exposing them to threats from actors seeking to exploit natural resources. In Peru, this situation is aggravated by illicit activities and limited state intervention, resulting in assassinations and conflicts. The general objective of this research is to demonstrate the deficient assistance provided by the Peruvian State regarding the violation of the fundamental rights of indigenous leaders in the Peruvian Amazon in defense of their peoples and the environment. As specific objectives: to identify the norms established for the protection of the environment in the Peruvian Amazon in the face of environmental crimes; to determine the main illicit activities against indigenous peoples and the environment that violate the fundamental rights of indigenous leaders in the Peruvian Amazon; to compare the effectiveness of international measures filed for the protection of the fundamental rights of indigenous leaders with Latin American countries; and finally, to analyze the main measures established by Peruvian legislation for the protection of the fundamental rights of indigenous leaders. A qualitative approach was used as methodology through documentary analysis of reports, articles, jurisprudence and news. The results indicate that illegal activities in the Peruvian Amazon are on the rise, as well as the murders of indigenous leaders, while the responsible entities do not effectively fulfill their role due to the scarce participation in meetings and the insufficient budgetary contribution for the better development of the intersectoral Mechanism.
