Defensa de los derechos del demandado ausente representado por un curador procesal

Abstract

El presente trabajo de investigación contiene el desarrollo del análisis de los derechos del demandado ausente en el transcurso del proceso civil, como los derechos a la tutela jurisdiccional efectiva, al debido proceso y a la defensa. El énfasis se ha puesto en el ejercicio del derecho de defensa que realiza el curador cuando se esté frente a un demandado ausente. En ese sentido, se analiza la eliminación de la procedencia del recurso de la consulta cuando las resoluciones de primera instancia contienen un fallo desfavorable para el ausente representado por un curador procesal. Con la finalidad de atender la deficiencia normativa respecto de los deberes y obligaciones del curador procesal y la errónea técnica legislativa de la modificación del inciso 2 del artículo 408 del Código Procesal Civil, se ha analizado la necesidad de continuar protegiendo los derechos del demandado pese a su ausencia en el proceso civil peruano; se ha explicado por qué es vital que las sentencias con fallo desfavorable para el ausente representado por un curador procesal sean elevadas en consulta y por qué se debe regular la actuación del curador procesal en el proceso civil peruano.

The present research work contains the development of the analysis of the rights of the absent defendant in the course of the civil process, such as the rights to effective jurisdictional protection, due process and defense. Emphasis has been placed on the exercise of the right of defense by the curator when facing an absent defendant. Thus, the elimination of the right to consult when the first instance resolutions contain an unfavorable ruling for the absent defendant represented by a procedural curator is analyzed. With the aim of addressing the regulatory deficiency regarding the duties and obligations of the procedural curator and the erroneous legislative technique of the amendment of paragraph 2 of Article 408 of the Code of Civil Procedure, it has been studied the need to continue protecting the rights of the defendant despite his absence in the peruvian civil process; it has been explained why it is vital that judgments with an unfavorable ruling for the absent defendant represented by a procedural curator be raised in consultation and why is necessary to regulate the performance of the procedural curator in the peruvian civil process.
