Propuesta legislativa para incorporar la transferencia y ocultamiento del patrimonio como agravante del delito de omisión a la asistencia familiar

Abstract

El artículo de investigación titulado “Propuesta legislativa para incorporar la transferencia y ocultamiento de patrimonio como agravante del delito de omisión a la asistencia familiar”,cuyo objetivo es proponer la incorporación de la transferencia y ocultamiento de patrimonio como agravante del delito de omisión a la asistencia familiar, en protección del principio de interés superior del niño y adolescente. Para lograr este objetivo general, se plantean dos objetivos específicos; el primero, es analizar exhaustivamente del delito de omisión a la asistencia familiar en la norma nacional y extranjera enfatizando similitudes y diferencias; el segundo, estudiar el interés superior del menor y la grave afectación a la materializacióndel derecho a la alimentación cuando el obligado no cuenta con patrimonio. En cuanto al marco metodológico, se tiene que es una investigación cualitativa, en la cual se emplea la técnica del análisis documental. Los resultados, verifican la necesidad que tiene el ordenamiento jurídico peruano de regular a la transferencia de bienes o la renuncia al trabajocomo agravantes del delito de omisión a la asistencia familiar; situación que ya se viene regulando en Honduras, Panamá y Argentina. Finalmente, se concluye que la incorporaciónen mención fortalecería la protección de los derechos de los menores, garantizando que se cumpla con la obligación alimentaria y tipificando conductas perjudiciales para el desarrollode los menores como sujetos pasivos del delito en cuestión.

Regarding the methodological framework, it is a qualitative research, in which the documentary analysis technique is used.The results verify the need for the Peruvian legal system to regulate the transfer of assets or resignation from work as aggravating factors of the crime of omission of family assistance;situation that is already being regulated in Honduras, Panama and Argentina. Finally, it is concluded that the incorporation in question would strengthen the protection of the rights of minors, guaranteeing that the maintenance obligation is complied with and classifying conduct that is detrimental to the development of minors as passive subjects of the crime inquestion.
