Resumen
En el presente informe se analizó la afectación del régimen de visitas en consecuencia de la alienación parental, abordando una problemática cada vez más frecuente en los procesos de familia en el Perú. Su propósito es visibilizar las implicancias jurídicas, emocionales y sociales que surgen cuando un padre manipula la decisión del menor en contra del otro, afectando negativamente la relación paterno-filial. Como objetivos específicos, fueron analizar los efectos de la alienación parental en la dinámica paterno-filial y su impacto en la configuración de un régimen de visitas adecuado para el menor, considerando el interés superior del niño. Por consiguiente, determinar qué criterio debe emplear el juez para configurar un régimen de visitas adecuado en casos donde se evidencie alienación parental, siempre en resguardo del interés superior del niño. Los resultados evidenciaron que efectivamente constituye una forma de afectación emocional que interfiere en el desarrollo afectivo del menor, motivo por el cual en el objetivo general se propuso incorporar un segundo párrafo del artículo 84 del CNA. Esta adición permitiría al juzgador valorar de manera expresa la existencia de conductas alienantes y establecer medidas concretas que aseguren el bienestar del niño.
In the present research, parental alienation was analyzed as a determining criterion in the establishment of the visitation regime, addressing an increasingly frequent problem in custody proceedings in Peru. Its purpose is to make visible the legal, emotional and social implications that arise when one of the parents manipulates the will of the child against the other, negatively affecting the paternal-filial relationship. The specific objectives were to analyze the effects of parental alienation on the parental-filial dynamics and its impact on the configuration of an adequate visitation regime for the child, considering the best interests of the child. Consequently, to determine what criteria the judge should use to configure an adequate visitation regime in cases where parental alienation is evidenced, always in the best interest of the child. The results showed that parental alienation constitutes a form of emotional affectation that interferes with the affective development of the child, which is why in the general objective it was proposed to incorporate a last paragraph in Article 84 of the Code for Children and Adolescents. This addition would allow the judge to expressly assess the existence of alienating behavior and establish concrete measures to ensure the child's welfare.
