Resumen
La presente investigación tuvo como propósito proponer mecanismos de coordinación institucional que garantice el cumplimiento del principio ne bis in ídem en los procedimientos administrativos disciplinarios. Para lograr esto, se llevó a cabo un análisis exhaustivo de los mecanismos de coordinación institucional. Asimismo, se justificó la necesidad de proponer estos mecanismos con la finalidad de llevar a cabo procesos céleres, así como garantizar el debido procedimiento de los PAD en función de evitar la vulneración del principio ne bis in ídem, el cual prohíbe la doble imposición de sanciones por parte de diferentes autoridades administrativas respecto de un mismo hecho. Este estudio se enmarcó en el paradigma interpretativo - cualitativo sobre el cual se buscó extraer información de la realidad recurriendo a la legislación comparada entre Chile, Colombia y Perú. En resumen, se determinó que la falta de mecanismos de coordinación institucional a nivel nacional, impide que las autoridades administrativas disciplinarias conozcan si determinado funcionario o servidor público se encuentra bajo un procedimiento administrativo disciplinario, por lo que, este trabajo permite argumentar la necesidad jurídica de plantear mecanismos de coordinación institucional que permitan la aplicación efectiva del principio ne bis in ídem en el ámbito de la administración pública.
The purpose of this research was to propose institutional coordination mechanisms to ensure compliance with the ne bis in idem principle in administrative disciplinary proceedings. To achieve this, an exhaustive analysis of institutional coordination mechanisms was carried out. Likewise, the need to propose these mechanisms was justified in order to carry out expeditious processes, as well as to guarantee the due process of the PADs in order to avoid the violation of the ne bis in idem principle, which prohibits the double imposition of sanctions by different administrative authorities with respect to the same act. This study was framed in the interpretative-qualitative paradigm on which we sought to extract information from reality by resorting to comparative legislation between Chile, Colombia and Peru. In summary, it was determined that the lack of institutional coordination mechanisms at the national level prevents the administrative disciplinary authorities from knowing whether a certain public servant is under an administrative disciplinary proceeding, so that this work allows arguing the legal need to propose inter-institutional coordination criteria that allow the effective application of the ne bis in idem principle in the field of public administration.
