El testamento militar otorgado a través de medios audiovisuales en bases militares como nueva formalidad testamentaria militar en el Perú

Abstract

La presente investigación tiene como objetivo general argumentar razones jurídicas que fundamentan la utilización de medios audiovisuales para otorgar el testamento militar en bases militares como nueva formalidad testamentaria militar en el Perú; partiendo de la situación existente en la guerra no convencional de lucha antiterrorista cuya base legal se ampara en la Constitución Política del Perú, en la cual participan los miembros de las Fuerzas Armadas en protección del Estado Peruano. Por consiguiente, el primer objetivo específico es explicar los antecedentes y evolución histórica del testamento militar y su regulación actual en el Código Civil. Y el segundo, analizar el uso de los medios audiovisuales como soporte de seguridad jurídica en la manifestación de última voluntad testamentaria militar en la legislación nacional y el derecho comparado. Para ello, se utilizó una metodología cualitativa y una investigación de tipo aplicada; partiendo del estudio de doctrina y normativa existente; utilizando a su vez fichas informativas que permitieron identificar fuentes de libros, diccionarios y revistas de actualidad militar que apoyaron en el sustento crítico investigativo. En este sentido, la presente investigación demuestra que resulta viable la incorporación de medios audiovisuales como soporte tecnológico de seguridad jurídica para otorgar el testamento militar; pues lo contenido en un audio y video exterioriza su última manifestación de voluntad de forma clara, efectiva y segura; encontrándose además, acorde a la situación de riesgo de muerte del militar al concurrir a la guerra; la protección de su transmisión hereditaria, y la innovación tecnológica del Derecho Sucesorio Peruano.The main objective of this research work is to argue juridical reasons that support the use of audiovisual media to grant the military will in military bases as a new military testamentary formality in Peru; starting from the existing situation in the unconventional war against terrorism whose legal support is protected by the Peruvian Political Constitution, in which members of the Armed Forces participate in defense of the Peruvian State. Therefore, the first specific objective is to explain the background and historical evolution of the military will and its current regulation in the Civil Code. And the second, to analyze the use of audiovisual media as a support for juridical security in the manifestation of military last testamentary will in national legislation and comparative law. For which, a qualitative methodology and applied research were used; starting from the study of existing doctrine and legal regulations; using in turn information sheets that allowed to identify sources of books, dictionaries and military news magazines that supported the critical investigative keep. In this sense, this research demonstrates that it is feasible to incorporate audiovisual media as a technological support for juridical security to grant the military will; due to the content of an audio and video externalizes the military last manifestation will in a clear, effective and secure manner; being also, in agree with the military risk of death situation when they participate in the war; the protection of his hereditary transmission, and the technological innovation of Peruvian Succession Law.
