Las medidas de protección utilizadas como impedimento para que el padre visite a sus hijos menores de edad

Abstract

La presente investigación tiene por objeto verificar la existencia de vulneración de los derechos del niño ante el impedimento de visitas al utilizar las medidas de protección. Es por ello que se hizo un análisis sobre las medidas de protección en nuestro país y el régimen de visitas que muchas veces se ve vulnerado; teniendo como consecuencia que en nuestra actualidad existe un mal manejo de este derecho al no existir una sanción para aquellos progenitores que niegan el derecho de visita al otro padre sin tenencia con sus hijos menores de edad. Precisando como fundamento del trabajo de investigación la protección del interés superior del niño, así como evitar conductas que trasgredan los derechos del menor o causar perjuicio a su integridad psicológica. Para la realización de la investigación se utilizó la metodología de enfoque cualitativo, teniendo información documental, haciendo un análisis de las distintas fuentes examinadas. . En efecto, a partir de losresultados logrados se precisó realizar la implementación de una sanción para los padres que utilizan las medidas de protección, como impedimento para que el progenitor que no tiene custodia visite a sus hijos menores de edad, cuando no se haya dispuesto el alejamiento para sus hijos

The purpose of this investigation is to determine the existence of violation of the rights of the child due to the impediment of visits when using protection measures. That is why an analysis was made of the protection measures in our country and the visitation regime that is often violated; The consequence is that currently there is a poor management of this right as there is no sanction for those parents who deny the right of visitation to the other non-custodial parent with their minor children. To carry out the research, the qualitative approach methodology was used, having documentary information, making an analysis of the different sources examined. . In fact, based on the results achieved, it was necessary to implement a sanction for parents who use protection measures, as an impediment for the father who does not have custody to visit his minor children, when no provision has been made estrangement for their children
