Abstract

Control judicial en la admisión de diligencias durante la detención preliminar para la protección de las garantías procesales del imputado, es el título de la tesis que se abordó. Se usó la metodología interpretativa de tipo aplicada – documental para desarrollar el objetivo de Implementar un marco normativo y procedimental que garantice el acceso expedito del imputado al juez durante la detención preliminar con el propósito de permitir la realización oportuna de actos de investigación, reduciendo las demoras injustificadas. Se analizaron tesis, artículos jurídicos, doctrina, normativa y jurisprudencia especializada en la investigación para brindar como conclusión la importancia de implementar un inciso más al artículo 261 del Nuevo Código Procesal Penal a fin de mejorar el principio de inmediatez del juez respecto de la solicitud presentada por la defensa técnica del imputado y así proteger sus garantías procesales.Judicial control in the admission of proceedings during preliminary detention for the protection of the procedural guarantees of the accused, is the title of the thesis that was addressed.
