Resumen
La presente investigación tiene como objetivo analizar cómo se ve afectada la protección de una sucesión intestada ante la concurrencia de medios hermanos con parientes colaterales de cuarto orden, enfocándose en las implicancias del artículo 829° del Código Civil peruano. Este establece una diferenciación entre hermanos bilaterales y unilaterales, otorgando a estos últimos una porción hereditaria reducida, lo cual resulta contrario al principio constitucional de igualdad. Se trata de una investigación básica, de enfoque cualitativo y diseño teórico fundamentado, basada en el análisis doctrinario, normativo, jurisprudencial y de derecho comparado. A través del método deductivo y la revisión documental, se identificaron patrones que evidencian una discriminación legal que vulnera derechos fundamentales y afecta la cohesión familiar. Entre los hallazgos más relevantes, destaca que dicha diferenciación no responde a criterios jurídicos objetivos ni refleja las transformaciones de las estructuras familiares modernas. Se concluye que el artículo 829° debe ser reformado o derogado para garantizar una sucesión intestada equitativa e inclusiva, respetando la igualdad de derechos entre herederos del mismo grado consanguíneo. Esta modificación no solo es jurídicamente viable, sino necesaria para alinear la normativa sucesoria con los principios constitucionales de no discriminación, cohesión familiar, dignidad humana y protección de todas las formas de familia.
The purpose of this research is to analyze how the protection of an intestate succession is affected by the concurrence of half-siblings with collateral relatives of the fourth order, focusing on the implications of Article 829° of the Peruvian Civil Code. This article establishes a differentiation between bilateral and unilateral siblings, granting the latter a reduced inheritance portion, which is contrary to the constitutional principle of equality. This is a basic research, with a qualitative approach and grounded theoretical design, based on doctrinal, normative, jurisprudential and comparative law analysis. Through the deductive method and documentary review, patterns were identified that show legal discrimination that violates fundamental rights and affects family cohesion. Among the most relevant findings, it stands out that such differentiation does not respond to objective legal criteria nor does it reflect the transformations of modern family structures. It is concluded that article 829° must be reformed or repealed to guarantee an equitable and inclusive intestate succession, respecting the equality of rights between heirs of the same consanguineous degree. This amendment is not only legally feasible, but necessary to align the inheritance regulations with the constitutional principles of non-discrimination, family cohesion, human dignity and protection of all forms of family.
