Resumen
El presente trabajo de investigación denominado "Implementación de mecanismos para promover la formalización de los trabajadores del hogar", se analizó los derechos laborales del trabajador del hogar, el impacto de la ley N°31047 en relación a la realidad de los ingresos e informalidad laboral. Asimismo, se explicó cómo la implementación de mecanismos impactará en la formalización del trabajador del hogar; finalmente, se establecieron mecanismos para promover la formalización de los trabajadores del hogar. Todo ello, a raíz de los altos índices de informalidad que viene presentando este sector laboral, desde hace muchos años atrás, más aún con la nueva Ley N°31047 que ha equiparado los derechos laborales de los trabajadores del hogar al régimen laboral del sector privado, a pesar de ser un trabajo que no genera lucro para el empleador, y lo termina sobrecargando con más obligaciones en relación a su trabajador. Para ello, se desarrolla el método de análisis-síntesis, que se llevó a cabo a través de artículos, revistas, libros, diversos trabajos de investigación nacionales y extranjeras. Seguidamente, se ha obtenido como resultado que, la implementación de mecanismos que promueven la formalización de los trabajadores del hogar, tiene un impacto positivo, pues, los empleadores obtienen beneficios, facilidades y/o simplificación de la carga que implica la contratación formal. Por eso, se ha propuesto el prorrateo de la gratificación, la deducción del impuesto a la renta para el empleador y la difusión de los gastos deducibles por pago de aportes a EsSalud de trabajadores del hogar.
The present research work called "Implementation of mechanisms to promote the formalization of domestic workers", analyzed the labor rights of domestic workers, the impact of Law 31047 in relation to the reality of income and labor informality. Likewise, it was explained how the implementation of mechanisms will impact the formalization of the domestic worker; Finally, mechanisms were established to promote the formalization of domestic workers. All of this, as a result of the high rates of informality that this labor sector has been experiencing for many years, even more so with the new Law No. 31047 that has equated the labor rights of domestic workers with the private sector labor regime, despite that it is a job that does not generate profit for the employer, and ends up overloading him with more obligations in relation to his worker. To do this, an analysis-synthesis method is developed, which was carried out through articles, magazines, books, and various national and foreign research works. Next, the result has been that the implementation of mechanisms that promote the formalization of domestic workers has a positive impact, since employers obtain benefits, facilities and/or simplification of the burden involved in formal hiring. For this reason, the proration of the bonus, the deduction of income tax for the employer and the dissemination of deductible expenses for payment of contributions to EsSalud of domestic workers have been proposed.
