Resumen
El presente trabajo contempló una propuesta legislativa para suprimir el tercer párrafo en el delito de enriquecimiento ilícito, referido a la existencia del indicio. Actualmente, teniendo en cuenta la corrupción que se vive, los delitos contra la administración pública cobran especial trascendencia pues son la respuesta directa de la justicia a este problema. Haciendo imperante que estos delitos, sean revestidos con la mayor claridad que puede otorgar el legislativo. Sin embargo, dentro del delito de enriquecimiento ilícito se encuentra una referencia a una herramienta procesal, como es el indicio, algo que claramente es incompatible con la naturaleza con que se deben tipificar los delitos. Esta investigación, trató de dar luz a este problema de claridad, por tal, el objetivo del trabajo fue establecer una propuesta legislativa para suprimir el tercer párrafo referido al indicio del delito del enriquecimiento ilícito. Pues la justificación, es sumar criterios que avalen una futura modificatoria dentro del Código Penal que pueda dar solución a esta problemática. Se utilizó un enfoque cualitativo, con un paradigma interpretativo, además de un tipo de investigación fundamental. Finalmente, producto de los resultados, se concluyó que el párrafo referido, produce ambigüedad y discrecionalidad en la aplicación de la ley, dificultando el trabajo de los operadores de justicia. Por lo tanto, la supresión de este se encuentra más que motivada.
This paper considered a legislative proposal to remove the third paragraph of the crime of illicit enrichment, referring to the existence of evidence. Currently, given the current corruption, crimes against public administration take on special relevance as they are the justice system's direct response to this problem. It is imperative that these crimes be presented with the greatest possible clarity by the legislature. However, within the crime of illicit enrichment, there is a reference to a procedural tool, such as evidence, which is clearly incompatible with the nature of the criminal offense. This research sought to shed light on this lack of clarity. Therefore, the objective of this paper was to establish a legislative proposal to remove the third paragraph, referring to evidence, from the crime of illicit enrichment. The justification is to add criteria that support a future amendment to the Penal Code that could address this problem. A qualitative approach was used, with an interpretive paradigm, in addition to a fundamental type of research. The results obtained concluded that the aforementioned paragraph creates ambiguity and discretion in the application of the law, hindering the work of justice officials. Therefore, its deletion is more than justified.
