Resumen
La investigación, enfocada en la gestión del drenaje pluvial en el Perú, tuvo como objetivo principal proponer la incorporación de la función de fiscalización, supervisión y control en la Ley General de Drenaje Pluvial. Utilizando un enfoque metodológico cualitativo, se analizaron posturas teóricas relacionadas y se desarrolló una propuesta normativa. Los resultados revelaron desafíos significativos en la coordinación interinstitucional, inversión pública y optimización de recursos para el drenaje pluvial, evidenciando un avance deficiente en proyectos en etapa de ejecución en el año 2024. Es así, que se identificó la ausencia de un régimen de fiscalización, supervisión y control dirigido a los gobiernos locales en la Ley General de Drenaje Pluvial, dificultando asegurar el cumplimiento de las disposiciones. En
respuesta, se propuso incorporar estas funciones en la ley en cuestión, designando al Ministerio de Vivienda, Construcción y Saneamiento como ente rector, estableciendo sus facultades y obligaciones de los tres niveles de gobierno. Esta medida legislativa busca garantizar un marco normativo sólido para la gestión eficiente, transparente y responsable de la infraestructura de drenaje pluvial en todo el territorio nacional, previniendo irregularidades y la optimización de proyectos ante eventos climáticos extremos.
The main objective of the research, focused on the management of storm drainage in Peru, was to propose the incorporation of the inspection, supervision and control function in the General Law of Storm Drainage. Using a qualitative methodological approach, related theoretical positions were analyzed and a normative proposal was developed. The results revealed significant challenges in inter-institutional coordination, public investment and optimization of resources for storm drainage, evidencing poor progress in projects in the execution stage in 2024. Thus, the absence of an inspection regime was identified, supervision and control directed at local governments in the General Storm Drainage Law, making it difficult to ensure compliance with the provisions. In response, it was proposed to incorporate these functions into the law in question, designating the Ministry of Housing, Construction and Sanitation as the governing body, establishing its powers and obligations of the three levels of government. This legislative measure seeks to guarantee a solid regulatory framework for the efficient, transparent and responsible management of storm drainage infrastructure throughout the national territory, preventing irregularities and optimizing projects in the face of extreme weather events.
