Sobre la nulidad de la Resolución Directoral n° 042-2022-IPDDNCTD/ SRND del Registro Nacional del Deporte

Abstract

El texto se centra en el análisis de la nulidad de la Resolución Directoral N° 042-2022- IPD- DNCTD/SRND, la cual inscribió al Grupo de Trabajo de la Federación Deportiva Peruana de Basketball (FDPB) en el Registro Nacional del Deporte (RENADE). Varias organizaciones deportivas solicitaron la nulidad de dicha resolución, lo cual fue respondido con la Resolución de Presidencia N° 026-2024-IPD/P. El estudio aborda las inconsistencias legales en la resolución de nulidad, señalando problemas en la normativa del RENADE y su interpretación. Además, se destaca la importancia del RENADE en el deporte peruano y se examina cómo la situación actual afecta la validez de las acciones administrativas. La investigación se formula con la hipótesis de que la nulidad se debe a la falta de claridad en la normativa del RENADE, específicamente en la comunicación con la Federación Deportiva Internacional correspondiente. Se sugiere, como recomendación, la revocatoria de la Resolución de Presidencia que causó la nulidad.The text focuses on analyzing the annulment of Directoral Resolution No. 042-2022-IPD- DNCTD/SRND, which registered the Working Group of the Peruvian Basketball Sports Federation (FDPB) in the National Sports Registry (RENADE). Several sports organizations requested the annulment of this resolution, which was responded to by Presidential Resolution No. 026-2024-IPD/P. The study addresses legal inconsistencies in the annulment resolution, highlighting issues in the RENADE regulations and their interpretation. Additionally, the importance of RENADE in Peruvian sports is emphasized, and the current situation's impact on the validity of administrative actions is examined. The research formulates the hypothesis that the annulment is due to a lack of clarity in the RENADE regulations, specifically in communication with the corresponding International Sports Federation. As a recommendation, the revocation of the Presidential Resolution that caused the annulment is suggested.
