La responsabilidad del heredero por las deudas y cargas de la herencia, modificación en el Código Civil peruano

Abstract

La presente investigación titulada “La responsabilidad del heredero por las deudas y cargas de la herencia, modificación en el Código Civil Peruano”, tiene como objetivo general proponer la modificación normativa del artículo civil 661° referente a la responsabilidad del heredero por las deudas y cargas de la herencia a fin de precisar que el artículo 1218° se regula en función de lo establecido en el libro de sucesiones, siendo sus objetivos específicos: Analizar la responsabilidad del heredero frente a la herencia teniendo en cuenta la legislación comparada de Argentina, Uruguay, Chile, Italia y España, evaluar hasta qué grado afectan las deudas y cargas de la herencia al patrimonio del heredero desde el ámbito nacional; y fundamentar doctrinariamente el sustento para la modificación del artículo 661° del Código Civil. La metodología utilizada fue de naturaleza básica, de tipo descriptiva y se adoptó un enfoque cualitativo, debido a que se buscó ampliar el conocimiento existente, teniendo como base la modificación normativa. Los resultados y conclusiones más relevantes de la investigación señalan el requerimiento de ajustar la legislación peruana para proteger de manera más efectiva al heredero frente a las deudas y cargas de la herencia, a través de un marco normativo sólido y armonioso que limite su responsabilidad sobre el patrimonio hereditario, teniendo como referencia la legislación comparada.

The present research entitled “The liability of the heir for the debts and burdens of the inheritance, modification in the Peruvian Civil Code”, has as general objective to propose the normative modification of civil article 661° referring to the liability of the heir for the debts and burdens of the inheritance in order to specify that article 1218° is regulated according to what is established in the book of successions, being its specific objectives: To analyze the liability of the heir against the inheritance taking into account the comparative legislation of Argentina, Uruguay, Chile, Italy and Spain, to evaluate to what extent the debts and burdens of the inheritance affect the estate of the heir from the national level; and to substantiate doctrinally the support for the modification of article 661° of the Civil Code. The methodology used was of a basic descriptive nature and a qualitative approach was adopted, since the aim was to broaden the existing knowledge, based on the normative modification. The most relevant results and conclusions of the research point out the need to adjust the Peruvian legislation to protect the heir more effectively against the debts and burdens of the inheritance, through a solid and harmonious regulatory framework that limits his liability on the inherited estate, taking as a reference the comparative legislation.
