Resumen
La presente investigación tiene por objetivo demostrar que la introducción de criterios normativos sustentados en el Derecho Penal Premial y la Política Criminal, evita el quebrantamiento del Principio de Proporcionalidad al otorgar beneficios premiales a las personas jurídicas como consecuencia del proceso de colaboración eficaz. Para ello, resulta esencial considerar la vigente Ley 30737, que asegura el pago inmediato de la reparación civil a favor del estado peruano en casos de corrupción y delitos conexos, debido a que, el citado dispositivo legal, contempla los beneficios premiales de las personas jurídicas que se someten al proceso de colaboración eficaz, sin embargo, no considera cuales son los estándares normativos para que estos se lleven a cabo de forma proporcional. El propósito de este estudio es que los beneficios premiales aprobados por el Juez se sustenten en fundamentos objetivos, con el fin de evitar que las personas jurídicas reciban beneficios desproporcionados. Para lograrlo, se efectuó una investigación analítica, basada en el análisis documental de normas, jurisprudencia y doctrina, lo que permite establecer criterios normativos adecuados a los fines del derecho penal, garantizando así que las concesiones premiales a personas jurídicas respeten el principio de proporcionalidad.
The purpose of this research is to demonstrate that the introduction of normative criteria based on Preliminary Criminal Law and Criminal Policy avoids the violation of the Principle of Proportionality when awarding preemptive benefits to legal entities as a consequence of the process of effective collaboration. For this purpose, it is essential to consider the current Law 30737, which ensures the immediate payment of the civil reparation in favor of the Peruvian State in cases of corruption and related crimes, due to the fact that, the aforementioned legal provision, contemplates the reward benefits of the legal entities that submit to the process of effective collaboration, however, it does not consider which are the normative standards for these to be carried out in a proportional manner. The purpose of this study is to ensure that the reward benefits approved by the judge are based on objective grounds, in order to prevent legal entities from receiving disproportionate benefits. In order to achieve this, an analytical research was carried out, based on the documentary analysis of norms, jurisprudence and doctrine, which allows establishing normative criteria adequate to the purposes of criminal law, thus guaranteeing that the granting of awards to legal entities respects the principle of proportionality.
