Resumen
Esta investigación tuvo como objetivo proponer un mecanismo legal que garantice el pago de la reparación civil a las víctimas menores de violación sexual, considerando que la normativa peruana presenta deficiencias en su ejecución. Como objetivos específicos, se planteó analizar la ausencia del pago de la reparación civil a las víctimas de violación sexual y argumentar la implementación del mecanismo para el pago de esta. Se empleó una metodología cualitativa, documental y aplicada, bajo el paradigma interpretativo, analizando fuentes normativas, jurisprudencia, tesis académicas y legislación comparada. Se identificó que el Decreto Legislativo N.º 1343, al establecer una retención del 20 % de los ingresos del interno, resulta insuficiente, y que la débil ejecución de mecanismos coercitivos, así como la escasa cultura de responsabilidad, afectan la efectividad del contenido resarcitorio de la sentencia. Frente a ello, se propone un mecanismo legal que condicione el acceso a determinados beneficios penitenciarios al cumplimiento total de la reparación civil impuesta en sentencia firme. Esta propuesta se sustenta en el principio de reparación integral y en el deber del Estado de garantizar el acceso efectivo a la justicia para víctimas en situación de vulnerabilidad. Los resultados evidencian que el cumplimiento de esta obligación no solo tiene implicancias jurídicas, sino también sociales, al facilitar la recuperación educativa, psicológica y médica de las agraviadas. Se reafirma así que la reparación civil es un componente esencial del régimen de ejecución penal y del enfoque de justicia restaurativa centrado en la víctima
The objective of this research is to propose a legal mechanism that guarantees the effective payment of civil reparation to minor victims of rape, considering that Peruvian law is eficient in its execution. As specific objectives, it was proposed to analyze the lack of payment of civil reparation to minor rape victims and to argue for the implementation of a legal mechanism for the effective payment of this reparation. A qualitative, documentary and applied methodology was used, under the interpretative paradigm, analyzing normative sources, jurisprudence, cademic theses and comparative legislation. It was identified that Legislative Decree No. 343, by establishing a retention of 20% of the inmate's income, is insufficient, and that the weak execution of coercive mechanisms, as well as the scarce culture of responsibility, affect the effectiveness of the compensatory content of the sentence. In view of this, a legal mechanism is proposed that conditions access to certain prison benefits to the total fulfillment of the civil reparation imposed in a final sentence. This proposal is based on the principle of full reparation and the State's duty to guarantee effective access to justice for victims in vulnerable situations. The results show that compliance with this obligation not only has legal implications, but also social ones, by facilitating the educational, psychological and medical recovery of the victims. This reaffirms that civil reparation is an essential component of the criminal enforcement regime and the victim-centered restorative justice approach..
