Razones jurídicas para otorgar carácter vinculante a las opiniones técnicas emitidas por el OSIPTEL en proyectos normativos y de inversión del MTC

Abstract

El OSIPTEL, como organismo regulador de las telecomunicaciones en Perú, cumple funciones supervisoras, regulatorias y sancionadoras, conforme a la Ley N° 27332; no obstante, su falta de capacidad para emitir opiniones técnicas vinculantes ha permitido que el MTC, como ente rector del sector, tome decisiones sin considerar criterios técnicos especializados, como ocurrió en el caso de la Red Dorsal Nacional de Fibra Óptica. En 2019, la OCDE recomendó fortalecer el rol del OSIPTEL y otorgar carácter vinculante a sus opiniones para mejorar la calidad regulatoria. La investigación evidencia la necesidad de otorgar dicho valor obligatorio a las opiniones técnicas del regulador, con el fin de evitar decisiones políticas no fundamentadas, mejorar la coherencia normativa y reducir errores en proyectos de inversión. Se busca así garantizar que el conocimiento técnico del OSIPTEL tenga un peso real en la regulación del sector telecomunicaciones.OSIPTEL, as the telecommunications regulatory body in Peru, performs supervisory, regulatory and sanctioning functions, in accordance with Law No. 27332; however, its lack of capacity to issue binding technical opinions has allowed the MTC, as the sector's governing body, to make decisions without considering specialized technical criteria, as occurred in the case of the National Fiber Optic Backbone Network. In 2019, the OECD recommended strengthening the role of OSIPTEL and granting binding nature to its opinions to improve regulatory quality. The research evidences the need to grant such binding value to the regulator's technical opinions, in order to avoid unfounded political decisions, improve regulatory coherence and reduce errors in investment projects. The aim is to ensure that OSIPTEL's technical knowledge has a real weight in the regulation of the telecommunications sector.
