Propuesta de aumento de la porción disponible del testador cuando sus ascendientes gocen de buena economía en Perú

Abstract

El presente trabajo de investigación tiene como finalidad proponer el aumento de la porción disponible del testador en caso de que sus únicos herederos forzosos sean sus ascendientes y estos gocen de una buena economía, pues se considera que la reserva impuesta en el artículo 726 de nuestro Código Civil es excesiva. Para eso fue imperante realizar un análisis de las figuras de legítima, porción disponible y orden sucesorio, comparar además el tratamiento de estas instituciones en otras legislaciones. Así se logró argumentar la importancia de dotar un mayor espacio de liberalidad al testador para disponer de sus bienes para después de su muerte. Pues a pesar de considerar necesaria la permanencia de la legítima en nuestra normativa, lo que se postula es un aumento de la porción disponible del testador para manifestar su voluntad cuando la subsistencia económica de sus ascendientes no recaiga en él, justificando este hecho en una búsqueda en la Superintendencia Nacional de Registros Públicos, donde de comprobarse que los ascendientes tengan bienes propios que les permita poder mantenerse por sí mismos y por tanto, no tener la necesidad de recibir un porcentaje alto de patrimonio del causante, se le dote al testador de una porción mayor de libre disposición. Lo antes mencionado, en aras de promover la preservación de la libre manifestación de voluntad, hecho que guarda relación con el derecho a la dignidad de las personas y su libertad, derechos que se encuentran protegidos constitucionalmente.

The purpose of this research work is to propose an increase in the portion available to the testator if his only forced heirs are his ascendants and they enjoy a good economy, since it is considered that the reservation imposed in article 726 of our Code Civil is excessive. For this, it was imperative to carry out an analysis of the figures of legitimate, available portion and succession order, also comparing the treatment of these institutions in other legislations. Thus, it was possible to argue the importance of providing greater space for liberality to the testator to dispose of his assets after his death. Well, despite considering the permanence of the legitimate right in our regulations to be necessary, what is postulated is an increase in the portion available to the testator to express his will when the economic subsistence of his ascendants does not fall on him, justifying this fact in a search in the National Superintendency of Public Records, where if it is verified that the ascendants have their own assets that allow them to be able to support themselves and therefore, do not have the need to receive a high percentage of the deceased's assets, the testator is provided with a larger portion of free disposal. The aforementioned, to promote the preservation of the free expression of will, a fact that is related to the right to the dignity of people and their freedom, rights that are constitutionally protected.
