Resumen
La presente investigación titulada “Paternidad mediante engaño insertado en un instrumento público como delito especial que afecta el derecho a la identidad del menor” se plantea en un contexto en el que se reconoce la importancia de proteger el derecho a la identidad de los menores. El engaño insertado en un instrumento público puede referirse a situaciones en las cuales se falsifica información en documentos legales, como actas de nacimiento, registros civiles o documentos de paternidad, con el propósito de atribuir la paternidad de un menor a una persona que no es su padre biológico. Teniendo como objetivo principal proponer la incorporación del delito de atribución de paternidad mediante engaño en un instrumento público en el Artículo 145°, a partir de los fundamentos legales, con el fin de evitar la afectación al derecho a la identidad del menor. El presente trabajo de investigación se enmarca en el paradigma cualitativo y es de tipo aplicada, no experimental y de la misma manera socio-jurídica, el nivel de la presente investigación es propositiva. Se empleó el método cualitativo.
This research, titled " Crime of paternal recognition through fraud inserted in a public instrument as a special crime that violates the right to identity of a minor” is set in a context where the importance of protecting the right to identity of minors is recognized. Fraud inserted in a public instrument can refer to situations in which information is falsified in legal documents, such as birth certificates, civil registries, or paternity documents, with the purpose of attributing the paternity of a minor to a person who is not their biological father. The main objective of this research is to propose the incorporation of the crime of attribution of paternity through fraud in a public instrument in Article 145° of the Peruvian Penal Code, based on legal grounds, in order to avoid the violation of the right to identity of the minor. This research is framed in the qualitative paradigm and is applied, non-experimental, and socio-legal in nature. The level of this research is propositive. The qualitative method was used.
