Incorporación del Seguro Social de Salud en la ley 26113-Secigra en conformidad con las modalidades formativas de la administración pública

Abstract

La presente investigación analiza el seguro social de salud en el contexto de los estudiantes que realizan el Servicio Civil del Graduando (SECIGRA) y los practicantes en Perú. Aunque el derecho al seguro social en salud se considera fundamental y universal, no se otorga a ciertos sectores, lo que genera una desprotección normativa y una falta de igualdad de condiciones para los secigristas. Así mismo, la investigación plantea la necesidad de incorporar el seguro social de salud en la ley 26113-SECIGRA para garantizar la igualdad de derechos en las modalidades formativas de la Administración Pública. Por lo que, se propone una visión descentralizada e igualitaria que permita mejorar las condiciones en la prestación de servicios. Es por ello por lo que, el objetivo general de la investigación es proponer los fundamentos para la incorporación del derecho al seguro social de salud para los secigristas. Para lograrlo, se plantean dos objetivos específicos: examinar los alcances del Servicio Civil del Graduando Derecho en Perú y analizar la importancia delseguro social de salud otorgado a los practicantes en las modalidades formativas del Decreto Legislativo 1401.Finalmente, la investigación se justifica en la importancia del seguro social de salud para los estudiantes que brindan servicios en entidades de la administración pública en Perú. No otorgar este beneficio representaría una discriminación hacia los secigristas, quienes realizan actividades similares a los practicantes bajo otras modalidades formativas. La propuesta busca reducir las brechas de desigualdad y mejorar las condiciones en las prestaciones del servicio y de salud de los estudiantes.This research analyzes the right to social health insurance in the context of students completingthe Graduate Civil Service (SECIGRA) and practitioners in Peru. Although the right to social health insurance is considered fundamental and universal, it is not granted to certain sectors, which generates a lack of regulatory protection and a lack of equal conditionsforsocialsecurity workers. Like wise, the research raises the need to incorporate the right to social health insurance in law 26113-SECIGRA to guarantee equal rights in the trainingmodalities of the Public Administration. Therefore, a decentralized and egalitarian vision is proposed that allows improving working conditions. That is why the general objective of the research is to propose the foundations for the incorporation of the right to social health insurance for secigristas. To achieve this, two specific objectives are proposed: examine the scope of the Civil Service of the Law Graduate in Peru and analyze the importance of the social health insurance granted to practitioners in the training modalities of Legislative Decree 1401. Finally, the research is justified in the importance ofsocial health insurance forstudents who provide servicesin publica dministration entities in Peru. Do not grant this right of representation of discrimination towards secigristas, who carry out activities similar to practitioners under other training modalities. The proposal seeks to reduce inequality gaps and improve the working and health conditions ofstudents.
