Las limitaciones a la libertad sindical por parte de la Policía Nacional del Perú en el ordenamiento jurídico peruano

Abstract

En la presente investigación el método a utilizar fue el analítico-sintético, pues se pretende estudiar y analizar cada elemento que rodea a la problemática materia de estudio, teniendo como punto de partida la problemática existente con respecto a la restricción de la libertad sindical dentro de la Policía Nacional del Perú, derecho que es inherente a cada persona por predicarse de su dignidad humana, asimismo hemos analizado el principio de subordinación, el cual es la columna vertebral de la organización policial, también analizaremos la legislación comparada, junto a las organizaciones internacionales que explican la participación del estado en la regulación de la libertad sindical, también estudiaremos las deficiencias por las atraviesan los integrantes de la policía por no contar con representantes que canalicen sus pedidos con respecto a una mejora en las condiciones de trabajo, remuneraciones y horario laboral, del análisis realizado concluimos que el ejercicio de la libertad sindical por parte de la Policía Nacional, es un tema que tiene asidero, pues consideramos que existe una necesidad en cuanto a la organización de los efectivos policiales para ejercer la negociación colectiva así como también por el desarrollo progresivo de los derechos laborales, después de haber analizado el reconocimiento de la libertad sindical en algunos ordenamientos jurídicos podemos concluir que ese acontecimiento también podría aplicarse en nuestro país pero aplicando algunos limites como son el no uso de armas de fuego en sus protestas y estas a la vez las deberían hacer vestidos de ropa civil.

In In this research, the method to be used is the analytical-synthetic one, since the aim is to study and analyze each element that surrounds the problematic subject of study, having as a starting point the existing problem with respect to the restriction of union freedom within of the National Police of Peru, a right that is inherent to each person because it is predicated on their human dignity, we have also analyzed the principle of subordination, which is the backbone of the police organization, we will also analyze comparative legislation, together with the organizations that explain the participation of the state in the regulation of freedom of association, we will also study the deficiencies that members of the police go through for not having representatives to channel their requests regarding an improvement in working conditions, salaries and hours. labor, from the analysis carried out we conclude that the exercise of freedom of association by the National Police is an issue that has a basis, since we consider that there is a need regarding the organization of police forces to exercise collective bargaining as well as for the progressive development of labor rights, after having analyzed the recognition of freedom of association in some legal systems, we can conclude that this event could also be applied in our country but applying some limits such as the non-use of firearms in protests. and these at the same time should be done dressed in civilian clothes.
