Resumen
Actualmente, los menores que tienen a sus progenitores privados de la libertad enfrentan diversas dificultades que limitan la materialización de su derecho a ser beneficiarios de una asistencia alimentaria suficiente y oportuna. Esta situación obedece a límites normativos en el ordenamiento jurídico peruano, los cuales impiden una debida atención a su condición de especial vulnerabilidad. Dichas carencias repercuten negativamente en su desarrollo y en la plena materialización del principio del interés superior del niño, el cual impone al Estado el deber de priorizar el bienestar del menor sobre cualquier otro interés. Ante dicha problemática, el eje central de esta investigación es proponer la modificatoria del artículo 93 del Código del Niño y del Adolescente, a partir de un análisis dogmático y jurisprudencial orientado a reforzar la protección del menor y garantizar su igualdad ante la ley. El análisis realizado con legislaciones extranjeras permitió advertir que, la redacción nacional vigente del citado artículo, no asegura un cumplimiento eficaz del deber alimentario cuando el responsable se encuentra en un supuesto de reclusión, lo que sustenta la necesidad de una modificación normativa que garantice este derecho en beneficio de los menores, conforme al citado principio. Respecto a la metodología, el estudio en curso se desarrolla dentro de una orientación cualitativa, aplicada, analítica, documental y sigue un paradigma interpretativo
Currently, minors whose parents are incarcerated face various difficulties that limit their ability to exercise their right to receive sufficient and timely food assistance. This situation is due to regulatory limitations in the Peruvian legal system, which prevent proper attention from being given to their particularly vulnerable condition. These shortcomings have a negative impact on their development and on the full realization of the principle of the best interests of the child, which imposes on the State the duty to prioritize the well-being of minors over any other interest. In view of this problem, the central focus of this research is to propose an amendment to Article 93 of the Code on Children and Adolescents, based on a dogmatic and jurisprudential analysis aimed at strengthening the protection of minors and guaranteeing their equality before the law. The analysis carried out with foreign legislation revealed that the current national wording of the aforementioned article does not ensure effective compliance with the duty of maintenance when the person responsible is in prison, which supports the need for a regulatory amendment that guarantees this right for the benefit of minors, in accordance with the aforementioned principle. With regard to methodology, this research is conducted within a qualitative, applied, analytical, documentary framework and follows an interpretive paradigm.
