Resumen
La pesquisa tiene como propósito determinar los criterios jurisprudenciales aplicables para la fijación de la indemnización por daño al trabajador devenido de actos de hostilización laboral negativa. Los objetivos específicos abordan el análisis de la naturaleza jurídica y los pronunciamientos jurisprudenciales sobre los actos de hostilización laboral negativa que conlleva a la indemnización, evaluar las disposiciones legales y mecanismos existentes en otros países sobre el carácter indemnizatorio a favor del trabajador devenido de actos de hostilización laboral negativa, y determinar el quantum de la tutela indemnizatoria sobre actos de hostilización laboral negativa. La metodología adoptada es cualitativa, basada en el estudio y examen de teorías y conceptos, respaldados por datos bibliográficos tanto físicos como virtuales. Los resultados esperados se centran en desarrollar lineamientos que permitan establecer un criterio unificado para la determinación del quantum indemnizatorio por daño moral producido por actos de hostilización laboral negativa, para salvaguardar los derechos de los trabajadores y propiciar un entorno laboral seguro y saludable.
The purpose of the research is to determine the applicable jurisprudential criteria for the determination of the indemnity for damage to the worker resulting from acts of negative labor harassment. The specific objectives address the analysis of the legal nature and the jurisprudential pronouncements on the acts of negative labor harassment that lead to indemnification, evaluate the legal provisions and mechanisms existing in other countries on the indemnifying nature in favor of the worker resulting from acts of negative labor arassment, and determine the quantum of the indemnifying protection on acts of negative labor harassment. The methodology adopted is qualitative, based on the study and examination of theories and concepts, supported by bibliographic data, both physical and virtual. The expected results are focused on developing guidelines to establish a unified criterion for the determination of the quantum of compensation for moral damages caused by acts of negative workplace harassment, in order to safeguard the rights of workers and promote a safe and healthy work environment.
