La posibilidad de admitir la tentativa en la modalidad agravada del delito de colusión desleal

Abstract

La investigación tiene como objetivo: Proponer la posibilidad de admitir la tentativa en la modalidad agravada del delito de colusión desleal. Con enfoque cualitativo, tipo básico, con el fin de realizar un análisis dogmático del delito de colusión desleal, previsto en el artículo 384° del Código Penal. En cuanto a los resultados, existe discordancia en la dogmática, con relación al segundo párrafo del artículo señalado; algunos autores sostienen, que es la modalidad agravada del delito del delito de colusión simple; y otros manifiestan que es un delito autónomo, al tener su estructura típica propia del delito, esto es sujeto activo, pasivo, conducta típica, objeto de delito. Asimismo, es un delito de resultado, cabiendo la posibilidad de admitir la tentativa.

The objective of the investigation is to propose the possibility of admitting the attempt in the aggravated modality of the crime of Unfair Collusion. With a qualitative approach, basic type, in order to carry out a dogmatic analysis of the crime of Unfair Collusion, provided for in article 384 of the Penal Code. Regarding the results, there is disagreement in the dogmatics, in relation to the second paragraph of the aforementioned article; Some authors maintain that it is the aggravated modality of the crime of simple collusion; and others state that it is an autonomous crime, having its own typical structure of the crime, that is, active subject, passive subject, typical behavior, object of crime. Likewise, it is a crime of result, with the possibility of admitting the attempt.
