Resumen
La presente investigación tuvo como objetivo principal analizar la reincorporación normativa del juez de ejecución en el Derecho Procesal Penal como garantía de eficacia del sistema penitenciario peruano. Para ello, se realizó un estudio bajo el método cualitativo, a través del análisis de la información recolectada. Esto, nos permitió demostrar la importancia de la judicialización de la ejecución penal en la legislación comparada más influyente, identificando así los beneficios que implicaría su reinstauración en el Perú, teniendo en cuenta que nuestro actual sistema penitenciario evidencia un control eminentemente administrativo de la etapa ejecutiva, lo cual, aunado al problema inobjetable del hacinamiento carcelario, termina obstaculizando la consolidación de un sistema más justo y eficaz. De esta manera, se concluyó que la reincorporación del “juez de ejecución penal” en nuestro ordenamiento jurídico permitirá, además de descargar las labores procesales del juez penal, adoptar un sistema acorde al derecho penitenciario moderno, vinculado especialmente a la protección de los derechos fundamentales y humanos del interno, a la efectivización del principio de resocialización y al cumplimiento de los principios constitucionales que se derivan de la cláusula del Estado Social y Democrático de Derecho.
The main objective of this research was to analyze the normative reincorporation of the execution judge in Criminal Procedural Law as a guarantee of the effectiveness of the Peruvian penitentiary system. For this, a study was carried out using the qualitative method, through the analysis of the information collected. This allowed us to demonstrate the importance of the judicialization of criminal execution in the most influential comparative legislation, thus identifying the benefits that its reinstatement in Peru would imply, taking into account that our current penitentiary system shows eminently administrative control of the executive stage. , which, combined with the unobjectionable problem of prison overcrowding, ends up hindering the consolidation of a more just and effective system. In this way, it was concluded that the reincorporation of the “criminal execution judge” in our legal system will allow, in addition to unloading the procedural tasks of the criminal judge, to adopt a system in accordance with modern penitentiary law, linked especially to the protection of fundamental rights. and human rights of the inmate, to the implementation of the principle of resocialization and to compliance with the constitutional principles that derive from the clause of the Social and Democratic State of Law.
