Resumen
El trabajo investigativo tiene por objeto establecer los fundamentos necesarios para modificar el régimen de contratación de exportación no tradicional, basándose en el principio de continuidad laboral. Se abordará la situación problemática causada por la inadecuada aplicación del art. 32° del D.L. N° 22342, el cual otorga discrecionalidad al empleador respecto a la continuidad del contrato, perjudicando así la seguridad en el puesto de trabajo. El estudio se inició con el análisis del impacto que genera el contrato de exportación no tradicional y la naturaleza de su temporalidad en el contexto actual, demostrando que su uso generalizado y sostenido en el tiempo carece de sustento en concordancia con su naturaleza eventual. Posteriormente, se examinó de qué manera el régimen de contratación de exportación no tradicional vulnera el principio de continuidad laboral, evidenciando así su desnaturalización y la precariedad generada por la excesiva flexibilidad contractual. Se profundizó en las decisiones jurisdiccionales, como las del TC y la corte suprema que reconocen la desnaturalización de estos contratos.
The research work aims to establish the necessary foundations to modify the non-traditional export hiring regime, based on the principle of job continuity. The problematic situation caused by the inadequate application of Article 32 of D.L. No. 22342 will be addressed, which grants the employer discretion regarding the continuity of the contract, thus harming job security. The study began with an analysis of the impact generated by the non-traditional export contract and the nature of its temporality in the current context, demonstrating that its widespread and sustained use over time lacks support in accordance with its eventual nature. Subsequently, the way in which the non-traditional export contracting regime undermines the principle of job continuity was examined, thus revealing its distortion and the precariousness generated by excessive contractual flexibility. The judicial decisions, such as those of the Constitutional Court and the Supreme Court, which recognize the distortion of these contracts, were examined in depth.
