Incorporación de pruebas psicológicas para contraer matrimonio, con la finalidad de prevenir la violencia familiar

Abstract

Esta investigación tiene como objetivo general proponer la incorporación de pruebas psicológicas en el marco de la institución matrimonial para evitar la violencia familiar. Entre sus objetivos específicos, busca analizar la evolución del matrimonio con relación a la familia, identificar el papel de la incorporación de pruebas psicológicas en el matrimonio como factor para erradicar la violencia familiar, y examinar la normativa peruana e internacional relacionada con el matrimonio, violencia familiar y salud mental para establecer el marco legal y ético de la implementación de la terapia psicológica. Enfoque en el paradigma cualitativo, esta investigación explora aspectos psicológicos del fenómeno de la violencia familiar, analizando factores que suelen estar subestimados en estudios previos. De tipo aplicada y documental, la investigación pretende crear un conocimiento útil para la reducción de casos de violencia familiar al integrar la dimensión psicológica en la prevención. Los resultados indican que el fortalecimiento de leyes de protección, como la Ley N° 30364 en Perú, ha tenido un impacto positivo en la seguridad dentro del matrimonio, promoviendo la sanción y prevención de la violencia. Sin embargo, es necesario incrementar la conciencia social y el empoderamiento de las víctimas, quienes ahora están más dispuestas a denunciar, apoyadas por redes de respaldo promovidas tanto por el Estado como por diversas organizaciones. Estas redes y las campañas de sensibilización deben ser clave en el proceso de generar un entorno familiar más seguro y equitativo, contribuyendo así a la reducción de la violencia dentro del matrimonio.

The general objective of this research is to propose the incorporation of psychological testing within the framework of marriage to prevent domestic violence. Its specific objectives include analyzing the evolution of marriage in relation to the family, identifying the role of incorporating psychological testing in marriage as a factor in eradicating domestic violence, and examining Peruvian and international regulations related to marriage, domestic violence, and mental health to establish the legal and ethical framework for implementing psychological therapy. Focusing on the qualitative paradigm, this research explores psychological aspects of the phenomenon of domestic violence, analyzing factors that are often underestimated in previous studies. The applied and documentary research aims to generate useful knowledge for reducing cases of domestic violence by integrating the psychological dimension into prevention. The results indicate that the strengthening of protective laws, such as Law No. 30364 in Peru, has had a positive impact on security within marriage, promoting the punishment and prevention of violence. However, it is necessary to increase social awareness and empower victims, who are now more willing to report, supported by support networks promoted by both the State and various organizations. These networks and awareness-raising campaigns should be key in the process of creating a safer and more equitable family environment, thus contributing to the reduction of violence within marriage.
