Resumen
La presente investigación tuvo por objetivo desarrollar una propuesta normativa que regule el uso de sustancias modelantes para fines estéticos en protección al derecho a la salud, figura jurídica que encuentra trascendental sustento en el hecho de que -actualmente- la legislación peruana -a través de la Ley General de Salud y disposiciones de DIGEMID- establece parámetros relevantes respecto a la realización de intervenciones estéticas; sin embargo, existe ambigüedad en la ley, debido a una falta de delimitación que especifique de forma literal a qué intervenciones (sean invasivas o estrictamente superficiales) se derivará el uso de cada sustancia modelante permitida por DIGEMID, situación que es necesario integrar en nuestro marco normativo, a efectos de garantizar la protección eficaz e integral del derecho a la salud, disminuir la tasa de daños irreparables derivados de una mala praxis en el ejercicio del acto médico y efectivizar el servicio de intervenciones estéticas a nivel nacional.
The objective of this research was to develop a regulatory proposal that regulates the use of modeling substances for aesthetic purposes in protection of the right to health, a legal figure that finds transcendental support in the fact that - currently - Peruvian legislation - through the General Health Law and DIGEMID provisions - establishes relevant parameters regarding the performance of aesthetic interventions; However, there is ambiguity in the law, due to a lack of delimitation that literally specifies which interventions (whether invasive or strictly superficial) will result in the use of each modeling substance permitted by DIGEMID, a situation that must be integrated into our framework. normative, in order to guarantee the effective and comprehensive protection of the right to health, reduce the rate of irreparable damage derived from malpractice in the exercise of medical acts and make the service of aesthetic interventions effective at the national level.
