El derecho a la libre circulación del trabajador como límite a la facultad fiscalizadora en la nueva ley de teletrabajo

Abstract

El presente estudio tuvo como objetivo de establecer las limitaciones del empleador en el ejercicio de su Facultad Fiscalizadora frente al Derecho a la Libre Circulación del teletrabajador, contribuyendo que se plasme en la nueva ley de teletrabajo las limitaciones del empleador y la correcta regulación en relación al derecho de libre circulación. Por lo cual fue necesario analizar el derecho a la libre circulación en el contexto de una relación de teletrabajo, pues no se hace mención expresamente en dicha ley peruana; así mismo analizar la facultad fiscalizadora en el contexto de teletrabajo, el cual nos lleva a proponer ciertas limitaciones que debe tener el empleador ejerciendo la facultad fiscalizadora, especialmente cuando esta entra en conflicto con el derecho fundamental a la libre circulación, dentro de una normativa vigente de teletrabajo. En efecto el estudio de este trabajo nos permitió plantear nuestro problema de investigación, abordando una metodología de carácter jurídico para orientar y garantizar el respeto de la dignidad de la persona en una relación de trabajo, a través de propuestas normativas basadas en el respeto de trabajador y empleador, plasmando limitaciones del empleador cuando requiera utilizar la facultad fiscalizadora que le corresponde como empresario. Todo ello dado en la modalidad de teletrabajo, modalidad adoptada por muchas empresas a raíz de la COVID 19.

The objective of this study was to establish the limitations of the employer in the exercise of its Supervising Faculty against the Right to Free Movement of the teleworker, helping to reflect in the new teleworking law the limitations of the employer and the correct regulation in relation to the right of free movement. Therefore, it was necessary to analyze the right to free movement in the context of a teleworking relationship, since it is not expressly mentioned in said Peruvian law; Likewise, analyze the supervisory power in the context of teleworking, which leads us to propose certain limitations that the employer must have when exercising the supervisory power, especially when it conflicts with the fundamental right to free movement, within a current regulation of teleworking. In effect, the study of this work allowed us to pose our research problem, addressing a legal methodology to guide and guarantee respect for the dignity of the person in a work relationship, through normative proposals based on respect for the worker. and employer, expressing limitations of the employer when he needs to use the supervisory power that corresponds to him as an entrepreneur. All this given in the teleworking modality, a modality adopted by many companies as a result of COVID 19.
