Implementación de medios tecnológicos al artículo 697 del Código Civil que contiene formalidades para cumplir la voluntad del testador analfabeto

Abstract

El presente trabajo tiene como objetivo implementar medios tecnológicos al artículo 697 del Código Civil para garantizar el cumplimiento de la voluntad del testador analfabeto. Para ello, se va a emplear una metodología cualitativa en el cual se realiza un análisis profundo y reflexivo acerca de la problemática planteada, por medio de teorías, conceptos y jurisprudencia, con el fin de brindar una solución al respecto. La investigación se centra en analizar del acto jurídico del testamento y la exteriorización de la manifestación de voluntad en los casos en los que el otorgante es analfabeto, determinar si las formalidades contenidas en el artículo 697 del Código Civil, garantizan el cumplimiento de la voluntad de dicho testador y proponer medios tecnológicos al artículo 697 del Código Civil. Los resultados revelan que la regulación actual en Perú, aunque se establezcan formalidades para los testadores analfabetos, no garantiza plenamente su voluntad en comparación con enfoques modernos adoptados en otros países como Francia, Cataluña, España, México y Brasil, lo que limita a que más personas realicen un testamento. Por tanto, una actualización más moderna y flexible de estas nuevas medidas mejoraría la seguridad jurídica de estos testadores mediante la implementación de medios tecnológicos.The purpose of this paper is to implement technological means to article 697 of the Civil Code in order to guarantee the compliance of the illiterate testator's will. For this purpose, a qualitative methodology will be used in which a deep and reflexive analysis of the problem raised will be carried out, by means of theories, concepts and jurisprudence, in order to provide a solution in this regard. The research is focused on analyzing the legal act of the will and the externalization of the manifestation of the will in cases where the grantor is illiterate, determining whether the formalities contained in article 697 of the Civil Code guarantee the fulfillment of the will of the testator and proposing technological means to article 697 of the Civil Code. The results reveal that the current regulation in Peru, although establishing formalities for illiterate testators, does not fully guarantee their will in comparison with modern approaches adopted in other countries such as France, Catalonia, Spain, Mexico and Brazil, which limits more people to make a will. Therefore, a more modern and flexible update of these new measures would improve the legal security of these testators through the implementation of technological means.
