Resumen
Los Estudios de Impacto Ambiental (EsIA) en el Perú son un instrumento clave de prevención ambiental y resultan fundamentales para el inicio de cualquier proyecto minero. No obstante, frente a la creciente problemática en el país, donde algunas empresas mineras contratan consultoras ambientales que elaboran EsIA con información falsa, se ha permitido la aprobación de proyectos extractivos que generan daño ambiente; sin embargo, pese a la existencia de sanciones impuestas a las consultoras ambientales resultan poco disuasorias en la práctica y en razón a este problema surge el propósito de esta investigación al proponer como evitar el daño ambiental producido por consultoras ambientales que realizan EsIA en proyectos mineros. Haciendo uso de un enfoque cualitativo y aplicado, debido a que se empleó la técnica del análisis documental y como instrumento el estado del arte compuesta por una búsqueda de libros, revistas, tesis, entre otras fuentes. Tras los resultados de este estudio, se logró revisar
casos emblemáticos que evidencian dichas irregularidades, se analiza la legislación comparada que protege al medio ambiente mediante un seguro ambiental obligatorio para evitar el daño ambiental, y se propone la creación de un seguro ambiental obligatorio para las consultoras ambientales.
Environmental Impact Assessments (EIA) in Peru are a key instrument of environmental prevention and are essential for the initiation of any mining project. However, in the face of the growing problem in the country, where some mining companies hire environmental consultants who prepare EIAs with false information, the approval of extractive projects that generate environmental damage has been allowed; however, despite the existence of sanctions imposed on environmental consultants, they are not very dissuasive in practice and because of this problem, the purpose of this research is to propose how to avoid the environmental damage produced by environmental consultants who carry out EIAs in mining projects. Making use of a qualitative and applied approach, due to the fact that the technique of documentary analysis was used and as an instrument the state of the art composed by a search of books, magazines, theses, among other sources. After the results of this study, we were able to review emblematic cases that evidence such irregularities, we analyzed the comparative legislation that protects the environment through a mandatory environmental insurance to prevent environmental damage, and we proposed the creation of a mandatory environmental insurance for environmental consulting firms.
