Resumen
La investigación estuvo dirigida a estudiar la falta de aplicabilidad del principio de predictibilidad judicial, pues se ha logrado evidenciar que en el sistema de justicia peruano, no sea aplica o se toma en consideración las decisiones emitidas por la Corte Suprema, ocasionando de esta manera que el sistema de justicia no brinde una correcta seguridad jurídica y peor aún una ineficiente celeridad procesal, es por ello que el estudio lleva como título “El Principio de Predictibilidad Judicial y el Reconocimiento del Carácter Remunerativo de la Bonificación Extraordinaria por Productividad en los Trabajadores Cesados de la Superintendencia de Banca Seguros y AFP - SBS, Lima 2017-2020”, para ello se formuló como objetivo general, proponer criterios jurisdiccionales en base al principio de predictibilidad judicial, en los casos sobre reconocimiento del carácter remunerativo de la bonificación extraordinaria por productividad en los trabajadores de la SBS, cabe mencionar que se tuvo como estructura metodológica, el tipo cualitativa documental, teórica y bibliográfica, la cual permitió profundizar eficientemente en el problema investigado, es por ello que se logró concluir que conforme al objetivo general, se pueden proponer criterios jurisdiccionales, basados en el principio de predictibilidad judicial, que la bonificación extraordinaria es de naturaleza remunerativa. Esta bonificación se otorga a los trabajadores como
resultado del servicio o desempeño productivo que ha contribuido eficientemente a los fines y objetivos de la institución. Además, cumple con la característica de regularidad en el pago, ya que, aunque se la califique como extraordinaria, sí se otorga de manera regular y predecible, y forma parte integral de la compensación económica del trabajador. Por último, esta bonificación es remunerativa porque el trabajador la percibe de manera similar a su salario regular, pudiendo disponer de ella para sus gastos y
necesidades. Por lo tanto, en relación a los expedientes judiciales de los trabajadores de la SBS u cualquier otra institución, las decisiones judiciales deben tener en cuenta estos criterios desarrollados y la aplicabilidad del principio de predictibilidad judicial a través de las casaciones de la Corte Suprema.

SBS, it is worth mentioning that the qualitative documentary, theoretical and bibliographic type was used as a methodological structure, which allowed an efficient deepening of the research problem, which is why it was possible to conclude that according to the general objective, they can be proposed as jurisdictional criteria, based on the principle of judicial predictability, that the extraordinary bonus is remunerative in nature. This bonus is granted to workers as a result of the service or productive performance that has contributed efficiently to the institution. In addition, it meets the characteristic of regularity in payment, since, although it is called extraordinary, if it is granted in a regular and predictable manner, it forms an integral part of the worker's financial compensation. Finally, this bonus is remunerative because the worker receives it in a similar way to his regular salary, and can use it for his expenses and needs. Therefore, in relation to the judicial files of SBS workers or any other institution, judicial decisions must take into account these developed criteria and the applicability of the principle of judicial predictability through cassations of the Supreme Court.
