Resumen
El trabajo de investigación se enfocó en la evaluación del desempeño docente con cargos directivos, conforme la Resolución Viceministerial N°138-2020. El objetivo general fue identificar criterios jurídicos que salvaguardan el principio meritocrático en la evaluación de desempeño. Se sostiene que el docente es un elemento clave para lograr la calidad educativa, y se analiza la transición de un sistema basado en el tiempo de servicio a uno que prioriza el mérito y el desempeño, a partir de la Ley de Carrera Pública Magisterial. La investigación adopta un enfoque interpretativo, utilizando la revisión de literatura y el análisis de documentos, tesis, informes y otros. Se aplicó el método hermenéutico para interpretar textos normativos, doctrina y jurisprudencia, con la finalidad de proponer criterios jurídicos que enfrenten los retos de la implementación de la reforma. Los resultados indican la necesidad de contar con criterios jurídicos que contribuyan a la mejora de la evaluación del desempeño docente con cargos directivos promoviendo un enfoque meritocrático en la carrera magisterial.
The research focused on evaluating the performance of teachers in management positions, in accordance with Vice-Ministerial Resolution No. 138-2020. The overall objective was to identify legal criteria that safeguard the meritocratic principle in performance evaluation. It is argued that teachers are a key element in achieving educational quality, and the transition from a system based on length of service to one that prioritizes merit and performance is analyzed, based on the Public Teaching Career Law. The research adopts an interpretive approach, using literature review and analysis of documents, theses, reports, and others. The hermeneutic method was applied to interpret normative texts, doctrine, and jurisprudence, with the aim of proposing legal criteria that address the challenges of implementing the reform. The results indicate the need for legal criteria that contribute to improving the evaluation of teachers in management positions, promoting a meritocratic approach in the teaching profession.
