Modificación del nomen iuris y contenido del artículo 107 del código penal de parricidio a homicidio en razón de parentesco

Abstract

El artículo 107 del Código Penal del Perú, presenta en la actualidad un vacio respecto a dos cuestiones, una de ellas es el nomen iuris que se le ha considerado a dicho artículo, el cual tiene por nombre “parricidio”, y como consecuencia su contenido, todo ello, en lo respecta a los sujetos que están bajo su protección. Dicho artículo, fue creado para proteger no solo la vida humana, sino también los lazos familiares que existen entre personas que conforman una misma familia. En razón a ello, es que se ha planteado la siguiente investigación, la cual tiene por objetivo explicar la problemática actual que presenta el artículo 107 del Código Penal, en lo que respecta a la adecuada e igualitaria protección de los miembros del grupo familiar, desarrollado desde la doctrina y la jurisprudencia. Asímismo, deviene en necesario sustentar la propuesta de modificación legislativa del artículo 107 del Código Penal, precisando los fundamentos de la normativa nacional que sustentan la modificación del antes mecionado artículo por “homicidio en razón de parentesco” y la incorporación de nuevos sujetos de protección en el mismo. Es necesario mencionar que, la información recabada será sustraída de libros, tesis, revistas, artículos, entre otras fuentes; de igual manera, se utilizará la técnica del fichaje la cual permite ordenar la información recabada a través de fichas textuales y bibliográficas. Por ende, con el análisis jurisprudencial de diversas sentencias, se ha obtenido como resultado que, existe en la actualidad una diferenciada e inadecuada proteccion de los integrantes de una familia, en lo que respecta a calificar los homicidios dados entre otros familiares, que no son los que considera el artículo 107. En síntesis, la modificación del artículo 107, garantizará la adecuada e igualitaria protección de los integrantes de la familia, tal y como lo manifiesta la Constitución Política y como se ha venido realizando en la diversa normativa nacional.

Article 107 of the Penal Code of Peru, currently presents a gap regarding two issues, one of them is the nomen iuris that has been considered to said article, as its content, this in regard to the subjects who are under his protection. Said article was created to protect not only life, but also the family ties that exist between people who make up the same family. Because of this, the following investigation has been proposed, which aims to explain the current problems presented by article 107 of the Penal Code, with regard to the adequate and equal protection of the members of the family group, developed from doctrine and jurisprudence. In addition, it becomes necessary to support the proposal for the legislative modification of article 107 of the Penal Code, specifying the foundations of the national regulations that support the modification of article 107 for homicide by reason of kinship and the incorporation of new subjects of protection. It should be added that the information collected will be taken from books, theses, magazines, articles, among other sources; Likewise, the signing technique will be used, which allows ordering the information collected through textual and bibliographic files. Therefore, with the jurisprudential analysis of various sentences, it has been obtained as a result that there is currently a differentiated and inadequate protection of the members of a family, with regard to qualifying the homicides given among other relatives, who are not those considered in the aforementioned article. In short, the modification of article 107, will guarantee the adequate and equal protection of the members of the family, as stated in the Political Constitution as various national regulations.
