Resumen
El presente trabajo aborda el análisis del criterio de sospecha plausible que se exige para la aplicación de la detención preliminar judicial y la propuesta de su modificación, buscando establecer un estándar más riguroso y objetivo que garantice que la privación de libertad se base en fundamentos sólidos y no en meras conjeturas o suposiciones. Por ello se propuso como objetivo proponer la modificatoria del criterio que exige sospecha plausible en la aplicación de la detención preliminar judicial en la norma procesal penal para proteger el principio de presunción de inocencia. La metodología empleada fue de modelo investigativo de tipo cualitativo con enfoque de una investigación aplicada, el cual se orientó en comprender y explorar la naturaleza del problema, mediante la interpretación y el análisis de contenido,
destacando la relevancia de buscar la aplicación práctica de los conocimientos adquiridos. Como resultado de la investigación, se advierte que la modificación del criterio de exigencia de sospecha plausible por sospecha suficiente en la aplicación de la detención preliminar judicial en la normativa procesal penal peruana constituiría un avance significativo en la protección del principio de presunción de inocencia. Por tanto, es imperativo que el sistema judicial peruano establezca un estándar probatorio adecuado para la detención preliminar judicial, asegurando así el respeto a los derechos fundamentales de los imputados y la integridad del proceso penal.
The present work addresses the analysis of the criterion of plausible suspicion that is required for the application of preliminary judicial detention and the proposal for its modification, seeking to establish a more rigorous and objective standard that guarantees that the deprivation of liberty is based on solid and not on mere conjectures or suppositions. For this reason, the objective was proposed to propose the modification of the criterion that requires plausible suspicion in the application of preliminary judicial detention in the criminal procedural norm to protect the principle of presumption of innocence. The methodology used was a qualitative investigative model with an applied research approach, which was oriented towards understanding and exploring the nature of the problem, through interpretation and content analysis, highlighting the relevance of seeking the practical application of knowledge acquired. As a result of the investigation, it is noted that the modification of the criterion requiring plausible suspicion for sufficient suspicion in the application of preliminary judicial detention in Peruvian criminal procedural regulations would constitute a significant advance in the protection of the principle of presumption of innocence. Therefore, it is imperative that the Peruvian judicial system establishes an adequate evidentiary standard for preliminary judicial detention, thus ensuring respect for the fundamental rights of the accused and the integrity of the criminal process.
