Propuesta de modificación a la edad máxima de los hijos mayores de edad que reciben una pensión alimenticia en Perú

Abstract

El presente artículo tiene como objetivo proponer la modificación a la edad máxima de los hijos mayores de edad que reciben una pensión alimenticia en Perú, la cual recae en el artículo 424° del Código Civil, con la finalidad de salvaguardar la subsistencia del obligado y establecer debida coherencia entre la norma y la realidad peruana. Para lograr tal objetivo fue necesario tomar en cuenta el derecho comparado con la finalidad de hacer un análisis frente a la realidad jurídica peruana, asimismo, se analizó la afectación a la subsistencia de los obligados a prestar alimentos a los hijos mayores de edad y se identificó cuáles deben ser los criterios para que los estudios de los alimentistas mayores de edad se consideren como satisfactorios, tomando en cuenta la Ley N°28044 - Ley General de Educación. La metodología que se aplicó es de tipo descriptivo, porque toma en consideración un atributo específico de la población a estudiar, la cual es “los hijos mayores de edad que reciben una pensión alimenticia”; y documental, porque se realizó un estudio de la Ley N° 27646 la cual modifica el artículo 424° del Código Civil, con la finalidad de identificar cual es el problema que versa en el sustento de dicha ley y determinar cuáles son los fundamentos a tenerse en cuenta para proponer una nueva modificatoria del artículo 424° del Código Civil.The objective of this article is to propose the modification of the maximum age of adult children who receive alimony in Peru, which falls on article 424 of the Civil Code, with the purpose of safeguarding the subsistence of the obligor and establishing due coherence between the norm and the Peruvian reality. To achieve this objective, it was necessary to take into account comparative law in order to make an analysis of the Peruvian legal reality. Likewise, the impact on the subsistence of those obliged to provide food to adult children was analyzed and the What should be the criteria for the studies of adult nutritionists to be considered satisfactory, taking into account Law No. 28044 - General Education Law. The methodology that was applied is descriptive, because it takes into consideration a specific attribute of the population to be studied, which is “the adult children who receive alimony”; and documentary, because a study was carried out on Law No. 27646 which modifies article 424 of the Civil Code, with the purpose of identifying the problem that is involved in the support of said law and determining what the foundations to be considered are. Taken into account to propose a new amendment to article 424 of the Civil Code.
