La incorporación del elemento descriptivo “Permanencia” en el delito de homicidio piadoso como garantía al derecho a la vida dentro de un estado social de derecho

Abstract

El homicidio piadoso es un tipo penal de dominio y autónomo que presenta una inconsistencia en la delimitación del supuesto de hecho, por cuanto, no se advierte una relación directa entre el elemento descriptivo “intolerables dolores” y la condición de incurable que debe tener la enfermedad del sujeto activo, para la configuración del delito. Esta situación, devenido en interpretaciones nocivas que desprotegen la vida como un derecho y buscan reconocer un supuesto derecho a morir. Por ello, esta investigación desarrollada mediante el método analítico busca analizar la incorporación del elemento descriptivo permanencia en el delito de homicidio por piedad y argumentar la garantía del derecho a la vida dentro de un Estado Social de Derecho. Así, se obtiene como resultado que los intolerables dolores del sujeto activo son consecuencia de la enfermedad incurable, ambos necesitan estar ligados por la permanencia, pues se presentan en una relación causa efecto, pues este problema ocasiona la ineficacia de las garantías a la vida según el modelo estatal. Por tanto, se propone de lege eferenda la incorporación del término “permanente” como elemento descriptivo del delito de homicidio pietístico, a fin de garantizar el derecho a vivir en un sentido absoluto.Merciful homicide is a domain and autonomous criminal type that presents an inconsistency in the delimitation of the factual assumption, since there is no direct relationship between the descriptive element "intolerable pain" and the incurable condition that the disease must have. of the active subject, for the configuration of the crime. Thus, it is obtained as a result that the intolerable pains of the active subject are a consequence of the incurable disease, both need to be linked by permanence, since they are presented in a cause-effect relationship, since this problem causes the ineffectiveness of the guarantees to life according to the state model. Therefore, it is proposed de lege eferenda the incorporation of the term "permanent" as a descriptive element of the crime of mercy killing, in order to guarantee the right to life in an absolute sense.
