Resumen
Este trabajo de investigación tiene como objetivo proponer una regulación legislativa para que los delitos cualificados por el resultado se conviertan en una circunstancia agravante cualificada. Por ello, el enfoque de esta investigación es de tipo cualitativo, pues primero se describen las características propias de los delitos cualificados por el resultado, como segundo punto, se explica cómo es que los delitos cualificados por el resultado vulneran el principio de proporcionalidad, para finalmente proponer legislativamente al delito cualificado por el resultado como agravante cualificada en la parte general del Código Penal para garantizar la vigencia del principio de proporcionalidad. Los resultados indican que, primero, las
circunstancias agravantes cualificadas y los delitos cualificados por el resultado incrementan la pena; segundo, este tipo delictual vulnera el principio de proporcionalidad; tercero, a través de la propuesta legislativa se tendría un solo criterio para fijar la pena a imponerse, no dejándole libre arbitrariedad al legislador imponer la sanción que crea correcta.
The purpose of this research work is to propose a legislative regulation so that crimes qualified by the result become a qualified aggravating circumstance. Therefore, the approach of this research is qualitative, since first the characteristics of the crimes qualified by the result are described, as a second point, it is explained how the crimes qualified by the result violate the principle of proportionality, to finally legislatively propose the crime qualified by the result as a qualified aggravating circumstance in the general part of the Penal Code to guarantee the validity of the principle of proportionality. The results indicate that, first, qualified aggravating circumstances and crimes qualified by the result increase the penalty; second, this type of crime violates the principle of proportionality; third, through the legislative proposal there would be a single criterion for setting the penalty to be imposed, not leaving the legislator free to arbitrarily impose the sanction that he believes to be correct.
