Clonación de matrículas y suplantación de embarcaciones en la pesca ilegal y su tipificación específica en el D. L. 1393

Abstract

El presente estudio se planteó como objetivo principal analizar la omisión normativa del artículo 3 del Decreto Legislativo N°1393 sobre interdicción ante actividades ilegales en la pesca, respecto a las conductas de clonación de matrículas y suplantación de embarcaciones, las mismas que no han sido reguladas de manera específica. Siguiendo un enfoque cualitativo, de tipo básico y diseño descriptivo, sustentado en el análisis documental y jurisprudencial, empleando el fichaje como técnica principal, se obtuvo como resultado que, ambas conductas ilegales facilitan la evasión de los mecanismos de control y fiscalización y la extracción no autorizada de recursos hidrobiológicos, especialmente durante vedas o en zonas restringidas. Además, se constató que el bien jurídico que peligra es el mismo que el de las otras conductas ya sancionadas, es decir, la biomasa marina; por ende, al no tipificarse en el marco sancionador pesquero la clonación de matrículas y la suplantación de embarcaciones se limita la capacidad del Estado para ejercer una respuesta efectiva contra la pesca ilegal. Se concluye, por tanto, en la necesidad de incorporar expresamente dichas conductas en el Decreto Legislativo N° 1393, con el fin de cerrar este vacío legal, reforzar el régimen sancionador en materia pesquera y asegurar la sostenibilidad del ecosistema marino.

The main objective of this study was to analyze the normative omission of Article 3 of Legislative Decree N° 1393 on interdiction against illegal activities in fishing, with respect to the conducts of cloning license plates and impersonation of vessels, which have not been specifically regulated. Following a qualitative approach, basic and descriptive design, based on documentary and jurisprudential analysis, using the file as the main technique, it was found that both illegal conducts facilitate the evasion of control and inspection mechanisms and the unauthorized extraction of hydrobiological resources, especially during closed seasons or in restricted areas. In addition, it was found that the legal asset at risk is the same as that of the other already sanctioned conducts, i.e., marine biomass; therefore, by not criminalizing the cloning of license plates and impersonation of vessels in the fisheries sanctioning framework, the State's capacity to exercise an effective response against illegal fishing is limited. It is therefore concluded that there is a need to expressly incorporate such conducts in Legislative Decree No. 1393, in order to close this legal void, strengthen the sanctioning regime in fishing matters and ensure the sustainability of the marine ecosystem.
