Resumen
La prisión preventiva es una medida cautelar que restringe la libertad personal, el desarrollo de audiencia debe garantizar los requisitos prescritos por el Código Penal, los principios jurídicos, así como los criterios jurisprudenciales de la materia, es posible si se establece el criterio que permite justificar el debate del juicio de tipicidad en el desarrollo de audiencia. En la investigación se planteó como objetivo general desarrollar los actos de prueba como criterio determinador del juicio de tipicidad en la audiencia de prisión preventiva en el sistema acusatorio. Se partió de la identificación de los principales antecedentes, se expuso la teoría que sustenta la investigación y, se desarrollaron las categorías conceptuales de: audiencia de prisión preventiva, juicio de tipicidad y actos de prueba. Seguidamente, se delimitó la metodología y diseño de la investigación bajo un enfoque cualitativo y se expuso el procedimiento y las técnicas para la recolección de datos. Además, se analizó la audiencia de prisión preventiva en el sistema acusatorio con énfasis en los principios jurídicos y el debate del juicio de tipicidad. Se procedió a individualizar los actos de prueba como criterio determinador del juicio de tipicidad, se examinó la valoración de los elementos probatorios, así como, los criterios jurídicos adoptados por la Corte Suprema de Justicia y el Tribunal Constitucional. Se concluyó que los actos de prueba es el criterio determinador del juicio de tipicidad en la audiencia de prisión preventiva, se exige que los elementos de convicción tengan este estatus. Por último, se abordaron las recomendaciones.
Preventive detention is a precautionary measure that restricts personal freedom, the development of the hearing must guarantee the requirements prescribed by the Penal Code, the legal principles, as well as the jurisprudential criteria of the matter, it is possible if the criterion is established that allows justifying the debate of the typicality judgment in the development of the hearing. The general objective of the research was to develop the acts of evidence as a determining criterion for the judgment of typicality in the preventive detention hearing in the adversarial system. The starting point was the identification of the main antecedents, the theory that supports the investigation was presented and the conceptual categories of: preventive detention hearing, criminality trial and evidentiary acts were developed. Next, the methodology and design of the research were defined under a qualitative approach and the procedure and techniques for data collection were explained. In addition, the preventive detention hearing in the adversarial system was analyzed with emphasis on legal principles and the debate on the criminality trial. The acts of evidence were individualized as determining criteria for the judgment of typicality, the assessment of the evidentiary elements was examined, as well as the legal criteria adopted by the Supreme Court of Justice and the Constitutional Court. It was concluded that the acts of evidence are the determining criteria for the judgment of criminality in the preventive detention hearing; it isrequired that the elements of conviction have thisstatus. Finally, recommendations were addressed.
