Resumen
El presente trabajo de investigación tiene como finalidad determinar las razones por las que se considera que existe una afectación al principio protector en la Ley N° 31602, que regula la licencia por fallecimiento de un familiar en el sector privado, toda vez, que refleja una regulación escueta que perjudican a los trabajadores, como la exclusión de figuras familiares como el concubinato y la tutela. Además, la falta de claridad en el cálculo de la remuneración para aquellos trabajadores con ingresos variables principales, lo cual genera desigualdades. Asimismo, para lograr el propósito, la metodología empleada es de tipo documental, con un enfoque cualitativo y un paradigma interpretativo, sustentada en la recopilación, análisis e interpretación de información proveniente de fuentes de tres tipos, normativas, doctrinales y jurisprudenciales para comparar el tratamiento de este tipo de licencia. Por lo que, los resultados sugieren la necesidad de modificar la legislación peruana en el sector privado, para asegurar una protección más adecuada de los derechos laborales en situaciones de duelo, alineándose con el principio protector, por el respeto de su dignidad humana.
The purpose of this research work is to determine the reasons why it is considered that there is an impact on the protective principle in Law No. 31602, which regulates leave due to the death of a family member in the private sector, since it reflects a brief regulation that is detrimental to workers, such as the exclusion of family figures such as concubinage, guardianship. In addition, the lack of clarity in the calculation of remuneration for those workers with variable income, which generates inequalities. Likewise, to achieve the purpose, the methodology used is documentary, with a qualitative approach and an interpretative paradigm, based on the collection, analysis and interpretation of information from three types of sources, normative, doctrinal and jurisprudential, to compare the treatment of this type of leave. Thus, the results suggest the need to modify Peruvian legislation in the private sector, to ensure a more adequate protection of labor rights in bereavement situations, aligned with the protective principle, for the respect of their human dignity.
