Incorporación de la coordinación de crianza como órgano auxiliar del juez de familia para garantizar el interés superior del niño

Abstract

La presente investigación tuvo como objetivo general, proponer la incorporación de la Coordinación de Crianza como órgano auxiliar del juez de familia en el artículo 159-A Sección VI del Código de los Niños y Adolescentes en aras de garantizar el Interés Superior del Niño. Para lograr ello, se analizó la Coordinación de Crianza desde la doctrina, norma y jurisprudencia comparada; asimismo, se explicó las razones jurídicas y fácticas que fundamentan la incorporación de esta institución jurídica como órgano auxiliar del juez de familia en Perú; también, se argumentó de qué manera la incorporación de la Coordinación de Crianza ampara el interés superior del niño. Finalmente, los resultados evidenciaron que el incremento de divorcios conflictivos en nuestro país ha generado el incumplimiento de las sentencias sobre tenencia y régimen de visitas, vulnerándose el derecho del menor a mantener con directo con el padre separado, así como a su desarrollo y bienestar integral. La razón principal de esta problemática es la carencia de instituciones jurídicas especializadas en conflictos familiares que coadyuven a solucionar las controversias parentales que generan la inejecución de las sentencias judiciales. El presente trabajo es cualitativo, de tipo documental con paradigma interpretativo y se ha utilizado la técnica de fichaje.

The general objective of this research was to propose the incorporation of the Parenting Coordination Office as an auxiliary body to the family court judge in Article 159-A, Section VI of the Children and Adolescents Code, in order to guarantee the best interests of the child. To achieve this, the Parenting Coordination Office was analyzed from the perspective of doctrine, regulations, and comparative jurisprudence. The legal and factual reasons underlying the incorporation of this legal institution as an auxiliary body to the family court judge in Peru were also explained. It was also argued how the incorporation of the Parenting Coordination Office protects the best interests of the child. Finally, the results showed that the increase in contentious divorces in our country led to noncompliance with judgments regarding custody and visitation, violating the child's right to maintain direct contact with the separated parent, as well as their development and overall well-being. The main reason for this problem is the lack of legal institutions specializing in family disputes that can help resolve parental disputes that lead to the non-enforcement of court rulings. This qualitative study is documentary in nature with an interpretive paradigm, using the indexing technique.
