Resumen
La investigación analiza las consecuencias laborales de la desnaturalización de contratos de locación sin concurso público en la Municipalidad del Distrito de San José en 2023. Este fenómeno, que implica la contratación de personal para funciones permanentes mediante contratos civiles, vulnera derechos laborales al encubrir una relación subordinada. Mediante una metodología cualitativa y documental, se examinaron contratos y normativas legales. Los resultados indican que estos contratos afectan a los trabajadores, limitando su acceso a beneficios como seguridad social, estabilidad y reposición en casos de despido arbitrario. La falta de concursos públicos fomenta la precarización laboral, mientras que el precedente Huatuco (STC N° 05057-2013-PA/TC) restringe la reposición a aquellos que ingresaron mediante concurso, intensificando la vulnerabilidad de quienes no lo hicieron. Se concluye que la práctica de contratos civiles sin concurso no solo perjudica a los trabajadores, sino que también va en contra de la transparencia en la administración pública. Se recomienda fortalecer la normatividad para garantizar contrataciones justas que respeten los derechos laborales.
The research explores the labor consequences of service contracts without public recruitment in the District of San José’s Municipality in 2023. This practice, involving civil contracts for permanent functions, undermines labor rights by concealing a subordinate relationship. A qualitative, document-based methodology was used to examine contracts and legal regulations. Findings reveal that these contracts affect workers by limiting access to benefits such as social security, job stability, and reinstatement in cases of arbitrary dismissal. The lack of public recruitment fosters labor precarization, while the Huatuco precedent (STC N° 05057-2013-PA/TC) restricts reinstatement only to those who entered via public recruitment, increasing the vulnerability of others. The study concludes that the use of civil contracts without recruitment processes not only harms workers but also contradicts transparency in public administration. Strengthening regulations is recommended to ensure fair recruitment that upholds labor rights.
