Resumen
La Ley N° 30057 – Ley del Servicio Civil, a partir del año 2014, trajo nuevas reglas en la gestión de Recursos Humanos, buscando unificar los tres regímenes laborales (276, 728 y 1057) en un único régimen laboral - SERVIR, procurando alcanzar mayores niveles de eficiencia y calidad a través de un mejor Servicio Civil. Esta ley reguló el Procedimiento Administrativo Disciplinario (PAD), el cual es eminentemente escrito y actualmente presenta algunas deficiencias en la aplicación de las sanciones disciplinarias y así, una falta disciplinaria puede sancionarse con una simple amonestación verbal o escrita, una suspensión temporal de hasta un (1) año o con la destitución definitiva del servidor público. La presente investigación tiene como objetivos establecer los criterios jurisprudenciales nacionales para la aplicación de las sanciones disciplinarias al servidor público según la Ley N° 30057; analizar las líneas jurisprudenciales sobre sanciones disciplinarias; explicar la gradualidad de las sanciones y describir los criterios tomados en cuenta para la proporcionalidad de las sanciones disciplinarias a los servidores públicos según la Ley N° 30057. En este sentido, se ha empleado el método analítico-sintético, pues se pretende estudiar y analizar cada elemento que rodea a la problemática materia de estudio; es decir, descomponer las partes que integran los motivos por los cuales las autoridades disciplinarias hacen un mal uso de la discrecionalidad para tomar sus decisiones y emitir diferentes sanciones sobre una misma falta disciplinaria. Se concluye que no hay una aplicación uniforme de las sanciones disciplinarias con la Ley N° 30057 y por lo tanto es necesario la propuesta de modificatoria respecto a la aplicación de las sanciones disciplinarias y limitar la discrecionalidad de las autoridades disciplinarias en el PAD.
Law No. 30057 – Civil Service Law, as of 2014, brought new rules in the management of Human Resources, seeking to unify the three labor regimes (276, 728 and 1057) into a single labor regime - SERVIR, seeking to achieve higher levels of efficiency and quality through a better Civil Service. This law regulated the Administrative Disciplinary Procedure, which is eminently written and currently presents some deficiencies in the application of disciplinary sanctions and thus, a disciplinary offense can be sanctioned with a simple verbal or written reprimand, a temporary suspension of up to one year. (1) year or with the definitive dismissal of the public servant. The objectives of this investigation are to establish the national jurisprudential criteria for the application of disciplinary sanctions to public servants according to Law No. 30057; analyze the jurisprudential lines on disciplinary sanctions; explain the gradual nature of the sanctions and describe the criteria taken into account for the proportionality of disciplinary sanctions to public servants according to Law No. 30057. In this sense, the analytical-synthetic method has been used, since it is intended to study and analyze. each element that surrounds the problematic subject of study; That is, breaking down the parts that make up the reasons why disciplinary authorities misuse their discretion to make their decisions and issue different sanctions for the same disciplinary offense. It is concluded that there is no uniform application of disciplinary sanctions with Law No. 30057 and therefore the proposed amendment is necessary regarding the application of disciplinary sanctions and limit the discretion of the disciplinary authorities in the PAD.
