Presupuestos jurídicos para la regulación de las billeteras electrónicas en el sistema financiero peruano

Abstract

Este trabajo tiene como propósito establecer los presupuestos jurídicos para regular las billeteras electrónicas en el sistema financiero peruano, de manera que ello pueda influir en el desarrollo de una base normativa sólida que permita el crecimiento ordenado de las finanzas digitales en el Perú. En este sentido, se busca realizar una exploración exhaustiva sobre el análisis doctrinario de las billeteras electrónicas, así como su implicancia en el sistema financiero peruano; además de comparar tanto enfoques normativos y legislativos internacionales, y finalmente determinar cuales son los presupuestos necesarios para una correcta regulación en el Perú. Así de una investigación exhaustiva, los resultados indican que es necesario establecer un marco regulatorio que contemple cuatro presupuestos jurídicos fundamentales: seguridad en las transacciones, protección al consumidor, mecanismos de resolución de reclamos y la inclusión financiera, los cuales pueden contribuir a mejorar la economía, pero también a democratizar los servicios financieros en el país.

The purpose of this paper is to establish the legal assumptions for regulating electronic wallets in the Peruvian financial system, so that it can influence the development of a solid regulatory basis that allows the orderly growth of digital finance in Peru. In this sense, we seek to conduct an exhaustive exploration on the doctrinal analysis of electronic wallets, as well as its implications in the Peruvian financial system; in addition to comparing both international regulatory and legislative approaches, and finally determine what are the necessary assumptions for proper regulation in Peru. After an exhaustive investigation, the results indicate that it is necessary to establish a regulatory framework that contemplates four fundamental legal assumptions: security in transactions, consumer protection, complaint resolution mechanisms and financial inclusion, which can contribute to improve the economy, but also to democratize financial services in the country.
